中哈霍尔果斯国际边境合作中心法律问题研究

【摘要】:2013年,习近平首次提出共建“一带一路”战略构想,其中“一带”指的是“丝绸之路经济带”,“一路”指的是“21世纪海上丝绸之路”。“一带一路”以实现区域发展为考量,而其实现需要通过与周边国家的合作方式开展。作为我国的一项重要战略部署,其有利于推动我国经济全方位对外开放,向更高水平、更广领域发展,同时,也顺应了我国经济深度融入世界经济趋势的倡议。2015年10月,我国召开十八届五中全会,提出了创新、协调、绿色、开放、共享的新发展理念,其中开放发展理念,对我国奉行互利共赢的开放战略,发展更高层次的开放型经济作出了明确的要求。因此,如何在“一带一路”战略构想下继续深化区域经济发展成为我国面临的重要议题。在与周边国家开展合作时,我们应该考虑区位与产业选择的合理性。在“一带一路”路线中,中亚地区便是不可忽略的重要区位。为了深化中哈边境贸易发展,促进区域一体化建设,中哈“霍尔果斯中心”应运而生,其是我国首个由两国中央政府通过签署双边条约而正式设立的跨境经济合作区。中哈“霍尔果斯中心”在理论上开辟了自由贸易区建设的新渠道,实践中拓展了毗邻国家边境地区经济优势互补的新领域。尽管如此,中哈霍尔果斯国际边境合作自2012年运营以来,却出现了法制建设动力不足、发展滞缓等负面现象,因此,在“一带一路”的新背景下,以中哈霍尔果斯国际边境合作为切入点,对中哈边境贸易法律制度予以深入研究则显得尤为必要。本文以“霍尔果斯中心”为切入点,首先,对“霍尔果斯中心”作出了界定,并在此基础上确阐释“霍尔果斯中心”的发展历程、发展优势及其发展趋势;其次,对“霍尔果斯中心”相关法律规定及其适用作出了叙述,并围绕管辖权、组织模式等制度的适用作出了具体阐述;再次,围绕双边协定及其实施层面对“霍尔果斯中心”的法律问题进行了阐述,其法律问题主要包括中哈双边条约可操性差、中哈法律制度协调性不足、组织机构设置协调性缺乏、常设性纠纷争端解决机制缺位等;最后,在“霍尔果斯中心”法律制度建设战略指导的前提下,结合域外跨境经济合作区成功经验,从增强中哈双边条约的可操作性、促进中哈两国法律制度的协调性、加快中哈互通信息领域立法工作、调整组织机构设置以及构建常设性纠纷争端解决机制五个层面对“霍尔果斯中心”法律问题的解决提出了相应的建议。
[Abstract]:In 2013, Xi Jinping first proposed a strategic concept of "Belt and Road", in which the "belt" refers to the "Silk Road Economic Belt" and the "one Road" refers to the "21st Century Maritime Silk Road." Belt and Road takes regional development as its consideration, and its realization needs to be carried out through cooperation with neighboring countries. As an important strategic deployment of our country, it is conducive to promoting the all-round opening up of our economy to a higher level and to a wider range of fields. At the same time, it also conforms to the initiative of our country's economic integration into the world economic trend in depth. In October 2015, China held the Fifth Plenary session of the 18th CPC Central Committee and put forward a new development concept of innovation, coordination, green, openness and sharing. The development of a higher level of open economy made clear requirements. Therefore, how to deepen the development of regional economy under the strategic conception of "Belt and Road" has become an important issue in China. In cooperation with neighboring countries, we should consider the rationality of location and industry choice. In the "Belt and Road" route, Central Asia is an important location that can not be ignored. In order to deepen the development of Sino-Kazakh border trade and promote the construction of regional integration, China and Kazakhstan "Holgos Center" emerged as the times require, which is the first cross-border economic cooperation zone formally established by the central government of the two countries by signing bilateral treaties. In theory, the "Horgos Center" has opened up a new channel for the construction of free trade zones, and in practice has expanded the new fields in which the economic advantages of the border areas of neighboring countries are complementary. Nevertheless, since the operation of the Sino-Kazakh Horgos International Border Cooperation in 2012, there have been negative phenomena such as insufficient impetus for legal construction and sluggish development. Therefore, in the new context of "Belt and Road," It is particularly necessary to study the legal system of border trade between China and Kazakhstan from the point of view of the international border cooperation between China and Kazakhstan. In this paper, "Holgos Center" is taken as the starting point. Firstly, the "Holgos Center" is defined, and on this basis, the development process, advantages and development trend of "Holgos Center" are explained. The relevant legal provisions and their application of the Holgos Center are described, and the application of jurisdiction, organizational model and other systems are described in detail. Thirdly, This paper expounds the legal problems of the Holgos Center around the bilateral agreement and its implementation. Its legal problems mainly include poor operation of bilateral treaties, insufficient coordination of the legal system between China and Kazakhstan, and lack of coordination in the setting up of organizations and institutions. Finally, on the premise of the strategic guidance of the construction of the legal system of the "Holgoz Center", combining with the successful experience of the extraterritorial cross-border economic cooperation zone, we can enhance the operability of the bilateral treaties between China and Kazakhstan. To promote the coordination of the legal systems of China and Kazakhstan, and to speed up the legislative work in the field of information exchange between China and Kazakhstan, In this paper, the author puts forward some suggestions on how to solve the legal problems of Horgos Center from the five aspects of adjusting the organization and setting up the dispute settlement mechanism of the permanent dispute.
