论欧盟金融监管改革与启示

【摘要】：金融危机突显了欧盟现有的国家分散监管框架的弱点,2010年9月22日欧洲议会通过了2009年9月欧盟委员会关于金融监管改革的系列提案,将成立负责宏观审慎监管的欧盟级别的监管机构——欧洲系统性风险管理委员会(ESRB);同时将原有证券、保险、银行监管委员会升级成为三大监管局(ESAs),赋予其争议调停和紧急情况下的决定权。欧盟新的金融监管架构将宏观审慎监管和微观审慎监管紧密结合起来,并且更注重成员国监管机构对欧盟规则的一致适用和紧急情况下的协调行动,同时也设立了保障条款以保护成员国的财政权不受侵犯。欧盟金融监管改革的主要理念和部分改革措施对中国宏观审慎监管职责设置和整合微观审慎监管系统方面提供了启示。
[Abstract]:The financial crisis has highlighted the weaknesses of the existing national decentralized regulatory framework in the EU, and on 22 September 2010 the European Parliament adopted a series of European Commission proposals on financial regulatory reform in September 2009, The European Commission for systemic risk Management (ESRB);), the EU level regulatory body responsible for macro-prudential regulation, will also insure the original securities. The Banking Regulatory Commission has been upgraded to a decision given to it by the (ESAs), the three regulators, in dispute mediation and emergency situations. The EU's new financial regulatory framework combines macroprudential and microprudential regulation closely and places greater emphasis on the consistent application of EU rules and coordinated action in emergency situations by the regulatory bodies of member States. Safeguards have also been established to protect the fiscal rights of member States from infringement. The main ideas and some reform measures of EU financial supervision reform provide enlightenment to the establishment of macro-prudential supervision duty and the integration of micro-prudential supervision system in China.
