国际药品贸易中人权保护的困境及其解决

【摘要】：国际药品贸易中受专利权保护的药品价格远远超出发展中国家人民的购买能力,从而侵犯了发展中国家人民的基本人权——生命权和健康权。TRIPS协议相关规则为实现药品贸易中的人权保护发挥了一定的积极作用,但仍存在不少缺陷,在完善和创新TRIPS协议的同时,亦可探索一些新的协调之法。
[Abstract]:The prices of drugs protected by patent rights in the international drug trade far exceed the purchasing capacity of people in developing countries. Thus violating the basic human rights of the people of developing countries-the right to life and the right to health. Trips rules have played a positive role in the protection of human rights in the drug trade, but there are still many shortcomings, While perfecting and innovating the TRIPS protocol, we can also explore some new methods of coordination.
