论南海断续线内历史性权利与《联合国海洋法公约》的关系——兼论如何从海法统合的角度维护南海断续线内历史性权利

【摘要】：历史性权利是个具有一定抽象性的概念,来源于习惯国际法,其具体内容取决于国家实践。《联合国海洋法公约》仅涉及历史性权利的“冰山一角”,无法取代历史性权利在国际法上的作用。历史性权利与《联合国海洋法公约》权利既不相互排斥,也无法相互吸收,在国际法上得以兼容。统合海洋法,向世界阐明这一事实的同时,落实和保障南海断续线内历史性权利。
[Abstract]:The historic right is a concept of a certain abstract nature, derived from customary international law, the specific content of which depends on State practice. The United Nations Convention on the Law of the Sea deals only with the "tip of the iceberg" of historic rights, There is no substitute for the role of historic rights in international law. The historical rights and the rights of the UN Convention on the Law of the Sea are neither mutually exclusive nor mutually absorbed and compatible in international law. While unifying the law of the sea and clarifying this fact to the world, the historical rights in the intermittent line of the South China Sea are implemented and protected.
