试论领土法的新发展——有效占领制度——兼论中印争议地区的归属
[Abstract]:In international judicial practice, for territorial disputes such as Sino-Indian territorial disputes, which do not have clear and formal evidence of legal rights, international tribunals or arbitral tribunals generally adjudicate the attribution of disputed areas through the effective occupation system. As the effective occupation system has gradually developed into a rule of customary international law, we can use the effective occupation system to judge the ownership of the disputed areas between China and India, and to determine the position and direction of the boundary line between China and India. By comparing the Chinese and Indian occupation of the disputed areas before the critical date, we can see that the disputed areas are Chinese territory. Therefore, the eastern section of the Sino-Indian border should be located in the southern part of the eastern Himalayas.
