国际法上侵略罪定义的发展

【摘要】：侵略罪作为习惯国际法上的罪行,由于其政治性等特点,国际社会一直未能形成一个能够被普遍接受的法律意义上的定义。国际刑事法院侵略罪特别工作组从国家的侵略行为与个人行为两个层面上对侵略罪的定义进行了长期艰苦卓绝的探索,最终在2010年《罗马规约》的审查会议上通过了关于侵略罪的修正案,以联大第3314(XXIX)号决议作为基础,将侵略罪界定为一种由政治或军事领导人实施的、依其特点、严重程度和规模构成对《联合国宪章》明显违反的犯罪。这是近年来关于侵略罪定义的最新成果。
[Abstract]:The crime of aggression as a crime in customary international law, because of its political characteristics, the international community has been unable to form a universally accepted definition of the legal sense. The Special working Group on the Crime of aggression of the International Criminal Court has undertaken a long and arduous exploration of the definition of the crime of aggression at both the level of acts of aggression by States and that of individuals, Culminating in the adoption at the Review Conference of the Rome Statute of 2010 of amendments to the crime of aggression, based on General Assembly resolution 3314 (XXIX), defining the crime of aggression as a crime of aggression committed by political or military leaders, according to its characteristics, The seriousness and scale of the crime constitute a clear violation of the Charter of the United Nations. This is the latest in recent years on the definition of the crime of aggression.
