我国入境非法移民的婚姻问题研究

【摘要】：非法移民是一个全球性的问题,在中国也存在一定数量的非法移民。这些非法移民在中国往往会和中国公民共同居住和生活,甚至组成婚姻家庭,尽管这样的婚姻并不能得到中国现行法律的承认和保护。但是国际法上的婚姻和家庭权利并不以当事人是否具备特定国籍身份为前提条件,因此入境非法移民的婚姻权利也理所应当得到保护。本文对我国境内非法移民的婚姻问题的成因、现状以及相关国际性法律文件进行梳理,希望引发和推动更多的人对我国境内非法移民的婚姻问题进行探索和研究,并促进我国有关法律法规的改进和完善。本文内容分为六个部分:第一部分是绪论,主要介绍本文的研究意义、研究现状和研究方法;第二部分是我国入境非法移民及其婚姻概述,将介绍入境非法移民及其婚姻情况分类并分析其成因;第三部分将分析入境非法移民在华缔结婚姻的风险;第四部分将分析非法移民婚姻行为对我国的影响;第五部分是有关非法移民的家庭、婚姻与子女权利的辨析,并结合《公民权利和政治权利国际公约》以及我国《国家人权行动计划(2016-2020)》中关于此类权利的规定进行分析;第六部分是关于保护入境非法移民婚姻权益的思考。
[Abstract]:Illegal immigration is a global problem, and there are a certain number of illegal immigrants in China. These illegal immigrants often live and live with Chinese citizens and even form marriage and family in China, even though such marriages are not recognized and protected by China's existing laws. However, marriage and family rights in international law do not presuppose whether the person concerned has a specific national status, so the marriage rights of illegal immigrants should be protected. This article combs the causes, the present situation and the relevant international legal documents of the marriage problem of illegal immigrants in China, hoping to cause and promote more people to explore and study the marriage problem of illegal immigrants in our country. And promote the improvement and perfection of the relevant laws and regulations of our country. The content of this paper is divided into six parts: the first part is the introduction, mainly introduces the research significance, the research present situation and the research method; the second part is our country entry illegal immigration and its marriage summary, The third part will analyze the risk of entering illegal immigrants' marriage in China, the fourth part will analyze the influence of illegal immigrants' marriage behavior on our country. The fifth part is about the family, marriage and children's rights of illegal immigrants, and analyses the provisions of the International Covenant on Civil and political Rights and the National Plan of Action on Human Rights (2016-2020). The sixth part is about the protection of the marriage rights of illegal immigrants.
