《保护世界文化和自然遗产公约》适用的困境与出路——以自然遗产保护为视角

【摘要】：《保护世界文化和自然遗产公约》是自然遗产保护领域内的纲领性文件,具有举足轻重的作用。由于公约制订时代的局限和实践的发展,公约在适用过程中暴露出来的问题日益增多。晚近,世界遗产管理委员会、区域组织等通过制订操作指南或区域性条约的方式,对公约在适用中存在的问题加以修正。作为公约的缔约国,中国正在进行自然遗产保护法的立法工作,如何利用公约,借鉴公约的立法经验,对我国自然遗产保护的立法具有重要的理论价值和现实意义。
[Abstract]:The Convention for the Protection of World Cultural and Natural Heritage is a programmatic document in the field of natural heritage protection, which plays an important role. Due to the limitations of the time of convention making and the development of practice, the problems exposed in the application of the convention are increasing day by day. More recently, the World Heritage Management Committee, regional organizations and so on through the formulation of operational guidelines or regional treaties, the convention in the application of the existing problems to be amended. As a signatory to the Convention, China is working on legislation for the protection of natural heritage. How to use the convention and learn from the legislative experience of the convention has important theoretical value and practical significance for the legislation of natural heritage protection in China.
