历史性权利与大陆架关系初论——兼议中国在南海大陆架上的历史性权利

【摘要】：经过长期的历史发展和国家实践,在国际法上逐渐形成了内容丰富的历史性权利规则。大陆架上的历史性权利是历史性权利的一项重要内容。一国能否在大陆架上享有历史性权利,需要从包括国际习惯、《联合国海洋法公约》等条约在内的整个国际法渊源中进行判定,确立大陆架制度的"专属性固有权利原则"并不当然地就能排斥和否定大陆架上的历史性权利。依据国际法及其相关国家实践,大陆架上完全可以融存历史性权利。经国家管理或授权的我国渔民依靠南海《更路簿》导引,长期、持续地在南海大陆架上捕捉马蹄螺、砗磲等定居种生物的行为,是我国在南海大陆架上切实享有历史性权利的权利基础。
[Abstract]:Through long-term historical development and state practice, historical rules of rights have been gradually formed in international law. The historic right on the continental shelf is an important part of the historic right. Whether a State can enjoy historic rights on the continental shelf needs to be determined from the entire source of international law, including treaties such as international custom, the United Nations Convention on the Law of the Sea, etc., The principle of exclusive inherent rights in the establishment of the system of continental shelf does not automatically exclude and negate the historical rights on the continental shelf. According to international law and relevant state practice, historical rights can be fully incorporated on the continental shelf. China's fishermen, who are under the management or authorization of the state, rely on the guidance of the South China Sea "Gangluo Book" to continuously catch the sedentary species of snails, Tridacas, and other sedentary species on the continental shelf of the South China Sea for a long period of time. It is the right foundation for our country to enjoy the historic rights on the continental shelf of the South China Sea.
