防治北极海域油类污染国际法规制问题研究
[Abstract]:As one of the virgin lands, the Arctic is rich in natural resources, among which the oil and gas reserves are amazing. With the further melting of sea ice, the prolongation of the ice-free period in the Arctic provides the possibility for the exploration of petroleum resources in the Arctic. Although the melting of sea ice has made it easier to develop, the foggy weather in summer and autumn season, the long night and strong wind in winter and the large area of ice floe in spring have brought great challenges to the development activities. This paper is entitled "study on the Regulation of International Law on Oil pollution in Arctic Sea area". The first chapter summarizes the situation of oil pollution in Arctic Sea area and the constitution of International Law Regulation on Oil pollution Control in Arctic Sea area. Chapter two, Chapter three reviews the international treaties, regional agreements and soft law documents issued by the Arctic Council on the prevention and control of oil pollution in the Arctic from a micro perspective. This paper analyzes the shortcomings of each international legal document from the introduction of the articles, and puts forward some suggestions on the perfection of each international legal document in each chapter. The fourth chapter is based on the review of various international legal documents, from a macro perspective to analyze the current prevention of oil pollution in the Arctic sea areas, the existing defects of the international regulation system, This paper mainly analyzes whether there is a lack of some kind of convention or document and whether there are any contradictions between the conventions, and puts forward some suggestions for its perfection. Although oil pollution in the Arctic has been effectively controlled on the surface, there are still loopholes in the control, such as the lack of international anti-pollution standards for offshore drilling platforms. There are different views on how to develop this standard. The author believes that it is more practical to guide Arctic countries to establish relatively consistent anti-pollution standards for offshore drilling platforms through the promulgation of soft law documents by the Arctic Council. At the same time, in Arctic affairs, our country can take advantage of the status of permanent observer to protect the Arctic marine environment from oil pollution.
