第二船舶登记制度研究

【摘要】：由于国际上各国船舶登记制度不统一，导致了方便旗船舶普遍兴起。这一现象对采用严格登记制度国家的船舶监管、海难事故管辖、海洋环境保护等诸多方面都造成了严重的负面影响。在欧洲的传统海运大国苦苦寻求因这种制度不统一而带来的各项困境的解决办法之时，第二船舶登记制度应运而生。在英国1978年率先开始实行该制度后，法国、荷兰、葡萄牙、挪威等多个国家相继实行了该制度。经过多年的实践表明，该制度对于解决这些国家的船舶登记流向问题确实起到了很大的作用。近年来,我国也面临着船籍外流现象严重的困境，为解决现状，理论界提出了很多的见解，其中第二船舶登记制度为很多学者所提倡，但关于我国是否完全具备了实行第二船舶登记制度的环境，，并未得出突破性的结论。因此，本文在吸取和借鉴众多优秀理论成果的基础上，立足于对第二船舶登记制度本身的特征进行研究，比较借鉴国外实行第二船舶登记制度的先进经验和失败教训，分析了我国实行第二船舶登记制度的可行性，并最终提出了完善我国船舶登记制度的建议。 在结构安排上，本文采用了硕士毕业论文的一般形式：界定基本概念——分析动因——考察实施效果——分析第二船舶登记制度在我国实施的可行性——提出我国船舶登记制度的完善建议。除引言和结语外，正文一共五个部分。 第一部分“第二船舶登记制度概述”。本部分介绍了船舶登记制度的相关概念，阐述了第二船舶登记制度的含义及来源，为下文的研究奠定了基础。 第二部分“第二船舶登记制度兴起之动因分析”。笔者从国际上方便旗船舶盛行带来的危害入手，通过对“方便旗”现象及其带来的弊端进行分析，结合国际上统一船舶登记制度的困难，概述了各国船舶登记制度不统一的现状以及国际上为统一船舶登记制度所做的相关努力。导引出第二船舶登记制度出现的背景。 第三部分“第二船舶登记制度之主要类型及特征分析”。通过对国际上出现的第二船舶登记制度的两种类型——离岸船舶登记制度和国际船舶登记制度的比较研究，以举例的方式详细分析了各自的特征，并归纳出两者的优劣。 第四部分“第二船舶登记制度实施效应分析”。通过对第二船舶登记制度在国际上部分国家多年以来的实践效果考察，总结了第二船舶登记制度的正面效应，也客观分析了第二船舶登记制度对登记国造成的各项负面效应，为我国船舶登记制度完善方法的选择提供了理论参考。 第五部分“中国船舶登记制度之完善建议”。笔者通过对我国船舶登记制度的现状以及存在的不足方面进行分析，结合理论界关于改革我国船舶登记制度的各项理论建设以及我国进行的吨税制试点等实践，研究了第二船舶登记制度在我国实行的可行性，并提出了中国船舶登记制度的完善建议。 最后，结语部分简要的概括和总结了文中内容。
[Abstract]:Because the international ship registration system is not uniform, it has resulted in the general rise of convenient flag ships. This phenomenon has a serious negative impact on ship supervision, maritime accident jurisdiction and marine environmental protection in strict registration system countries. The second ship registration system came into being when the traditional maritime giant in Europe struggled to find a solution to the difficulties arising from the inconsistency of such a system. After the introduction of the system in 1978, France, the Netherlands, Portugal and Norway have successively implemented the system. After years of practice, the system has played a great role in solving the problem of ship registration and flow in these countries. In recent years, China also faces a serious dilemma of the outflow of ships. In order to solve the present situation, many opinions have been put forward in the theoretical circle, among which, the second ship registration system has been advocated by many scholars, but with regard to whether our country fully has the environment for carrying out the second ship registration system, There was no breakthrough conclusion. Therefore, on the basis of drawing and drawing lessons from many excellent theories, this paper bases on the study of the characteristics of the second ship registration system, and draws lessons from the advanced experience and failure of the second ship registration system.
