《反倾销协定》中新出口商复审制度的不足及改善方案

【摘要】：目前,反倾销新出口商复审制度确实存在被部分出口商或供应商利用于规避反倾销措施。因此,有必要规定具有代表性出口和详细的调查及裁定程序。而且,因为对新出口商来说,新出口商复审具有原审的功能,因此要适用原审中所适用的程序规定。此外,要明确规定具有代表性出口的概念,并将复审期限规定为9个月。
[Abstract]:At present, anti-dumping new exporters review system does exist by some exporters or suppliers to circumvent anti-dumping measures. It is therefore necessary to provide for representative exports and detailed investigation and adjudication procedures. Moreover, since the new exporter's review has the function of original review, the procedural provisions applicable in the original trial are applied. In addition, the concept of representative exports should be clearly defined, and the review period should be set at 9 months.
