妇女劳动权国际保护问题研究

【摘要】:妇女人权是在人权观念产生300多年后出现的一个似乎含义重叠的概念,妇女劳动权则是妇女人权的重要内容之一。面对妇女人权的特殊性,我们仅仅研究妇女劳动权的现状,追究妇女遭受歧视的根源,讨论其发展的历史,并不能在真正意义上提升妇女的人权地位,消除妇女人权歧视。针对这一现象,本文以妇女劳动权相关理论为基础,来探讨妇女劳动权国际保护机制,完善妇女劳动权国际保护机制,旨在彻底改变妇女人权受歧视的地位。 妇女劳动权的法律地位如何,其国际保护机制如何,发展到现在已经成为国际社会关注的一个热点问题,把妇女劳动权国际保护作为一种法律制度进行专门研究,具有非常积极的理论价值和重要的现实意义。 第一章介绍了妇女劳动权国际保护的概述。一方面,对妇女劳动权的内容作了界定,并探究了妇女劳动权国际保护的必要性。另一方面,阐述了妇女劳动权国际保护法律制度的演变。通过论证,奠定了妇女劳动权的理论基础。 第二章对妇女劳动权国际保护机制进行了深入地分析。妇女劳动权国际保护机制由妇女劳动权国际保护的立法、妇女劳动权国际保护的机构及妇女劳动权的实施措施共同组成的。因此,本章从动态的保护实施措施和静态的保护立法及保护机构加以阐述。 第三章阐述妇女劳动权国际保护机制的不足。本章结合国际社会妇女劳动权国际保护的相关立法,从妇女劳动权的保护现状出发,揭示妇女劳动权保护的种种不足,主要阐述:1.妇女劳动权国际保护内容的缺陷;2.妇女劳动权国际保护执行机制的不足。 第四章提出了完善妇女劳动权国际保护机制的几点建议。本章针对妇女劳动权国际保护存在的不足与缺陷,从理论上和制度上提出了完善意见。1.完善妇女劳动权国际保护机制的内容,为追求妇女劳动权实质平等,应完善妇女人权公约和协调国际国内人权立法;2.加强妇女劳动权国际保护机制的实施与监督,设置专门机构和限制国家的保留制度,来加强对妇女劳动权国际保护的监督。
[Abstract]:The human rights of women is a concept that appears to have overlapping meanings more than 300 years after the emergence of the concept of human rights, and the right to work of women is one of the important contents of women's human rights. In the face of the particularity of women's human rights, we can only study the present situation of women's labor rights, investigate the root causes of discrimination against women, and discuss the history of their development, which can not promote women's human rights status and eliminate women's human rights discrimination in real sense. In view of this phenomenon, based on the related theories of women's labor rights, this paper probes into the international protection mechanism of women's labour rights and consummates the international protection mechanism of women's labour rights, aiming at completely changing the status of women's human rights being discriminated against. The legal status of women's labour rights and their international protection mechanisms have now become a hot issue of concern to the international community. The international protection of women's labour rights has been specially studied as a legal system. It has very positive theoretical value and important practical significance. The first chapter introduces the international protection of women's labor rights. On the one hand, it defines the content of women's right to work, and probes into the necessity of international protection of women's right to work. On the other hand, it expounds the evolution of the international protection legal system of women's labor rights. Through argumentation, laid the theoretical foundation of women's right to work. The second chapter deeply analyzes the international protection mechanism of women's labor rights. The international protection mechanism of women's labor rights is composed of the legislation of international protection of women's rights to work, the institutions of international protection of women's rights to work and the implementation measures of women's rights to work. Therefore, this chapter from the dynamic protection implementation measures and static protection legislation and protection agencies to elaborate. The third chapter elaborates the insufficiency of the international protection mechanism of women's right to work. This chapter combines the relevant legislation of the international community women's labor rights protection, from the women's labor rights protection status quo, reveals the women's labor rights protection of various shortcomings, mainly elaborated: 1. Deficiencies in the content of International Protection of Women's Labour Rights; 2. Inadequate implementation mechanisms for the international protection of women's labour rights. The fourth chapter puts forward several suggestions to perfect the international protection mechanism of women's labor rights. This chapter aims at the deficiency and defect of the international protection of women's right to work, and puts forward some perfect suggestions in theory and system. 1. To perfect the content of the international protection mechanism of women's labor rights, we should perfect the women's human rights conventions and harmonize the international and domestic human rights legislation in order to pursue the substantive equality of women's labor rights. To strengthen the supervision of the international protection of women's labour rights, we should strengthen the implementation and supervision of the international protection mechanism of women's labour rights, set up specialized agencies and restrict the state's reservation system.
