网上国际商事仲裁仲裁地确定的研究

【摘要】：随着经济的发展、科技的进步、电脑的普及、网络的盛行和电子商务的推广,传统的国际商事活动在全球化进程中越来越多的通过因特网进行。网上国际商事仲裁作为仲裁领域的最新动向和一种快捷、灵活、方便的有效方式随着因特网的发展而得到迅速运用,但是由于网络的虚拟性,导致网上国际商事仲裁的仲裁地很难确定,而仲裁地的确定又具有非常重要的意义。 目前,有关网上国际商事仲裁的实践已经出现,如美国仲裁协会的虚拟法官项目、世界知识产权组织仲裁和调解中心、网上法庭等机构已经制定了网上仲裁规则,开始了网上仲裁的尝试,并取得了一定的成绩。由于网上争议解决实践发展尚不成熟,因而学界对网上争议解决机制的研究也不够深入,时至今天,许多问题依然处于“尚在讨论”的阶段而没有形成定论,传统的商事仲裁中有仲裁机构所在地理论和仲裁机构或仲裁庭决定论两种学说,而网上国际商事仲裁仲裁地的确定,目前主要有仲裁员所在地论、服务器所在地论、网址所有者或者控制者所在地论、仲裁本座论和非内国仲裁理论等五种理论。国内外实践部门及学术界虽然已经进行了一定程度的研究,也有一些零星的研究文章出现,但对网上国际商事仲裁仲裁地的确定问题没有系统的考察,也没有专门的著作,所以很有必要对网上国际商事仲裁仲裁地的确定主动的进行前瞻性的研究,以推动相关法律文件的出台,适用网络经济的客观要求,促进仲裁的发展。 本文拟用逻辑分析法、文献研究法、比较分析法、理论与实践相结合的方法和交叉学科研究法,对网上国际商事仲裁进行比较系统的讨论,期望通过当事人意思自治、仲裁本座和制定示范性的仲裁地条款从根本上解决这一难题。本文抛砖引玉,意在引起学界对网上仲裁争议解决的进一步关注,并希望能对推动网上国际商事仲裁实践的发展有所裨益。
[Abstract]:With the development of economy, the progress of science and technology, the popularization of computer, the popularity of network and the popularization of electronic commerce, the traditional international commercial activities are more and more carried out through the Internet in the process of globalization. As the latest trend in the field of arbitration, online international commercial arbitration has been used rapidly with the development of the Internet, but because of the virtual nature of the network, As a result, the place of arbitration is difficult to determine, and the place of arbitration is of great significance. At present, the practice of online international commercial arbitration has emerged. For example, the Virtual judges Project of the American Arbitration Association, the arbitration and conciliation center of the World intellectual property Organization, online courts and other institutions have formulated online arbitration rules. Started the attempt of online arbitration, and made certain achievements. Because of the immature development of online dispute resolution practice, the research on online dispute resolution mechanism is not deep enough in academic circles. Up to now, many problems are still in the stage of "still under discussion" and no final conclusion has been reached. In the traditional commercial arbitration, there are two kinds of theories: the theory of the location of the arbitration institution and the determinism of the arbitration institution or the arbitration tribunal. At present, the determination of the place of international commercial arbitration on the Internet mainly includes the theory of the location of the arbitrator, the theory of the location of the server, There are five theories: site theory, arbitration theory and non-domestic arbitration theory. Although domestic and foreign practice departments and academic circles have carried out a certain degree of research and some sporadic research articles have appeared, there is no systematic investigation on the determination of the place of international commercial arbitration on the Internet, nor has there been any specialized work. Therefore, it is necessary to make a forward-looking study on the determination of the place of online international commercial arbitration in order to promote the publication of relevant legal documents, to apply the objective requirements of the network economy, and to promote the development of arbitration. This paper intends to use logical analysis, literature research, comparative analysis, theory and practice combined method and interdisciplinary research method to discuss online international commercial arbitration systematically, hoping to pass party autonomy. Arbitration and the formulation of exemplary arbitration terms fundamentally solve this problem. The purpose of this paper is to draw further attention to online arbitration dispute resolution in academic circles and hope to promote the development of online international commercial arbitration practice.
