空间碎片减控法律制度研究

【摘要】：自航天时代开始至今，地球轨道已经被高度使用。大量的人造卫星导致了数量庞大的空间碎片遗留在地球轨道上，，致使一部分地球轨道失去其效用。令人遗憾的是，现在仍然没有一个专门的国际条约来规范空间碎片问题。虽然存在一些技术标准可以减缓空间碎片问题，但是为了更好的保护外层空间环境，这些技术标准需要连同法律制度一起才能有效地规范空间碎片的产生和减缓。本文从空间碎片减控法律制度的涵义、特征及其内容和理论基础出发，通过对外空条约和美俄两国国内空间碎片减控法律进行研究，分析我国立法的不足。同时，对我国如何完善空间碎片减控立法提出自己的建议，以期使我国更好地履行条约义务，保护外层空间环境。本文除了序言和结语外，共分为四章。 第一章概述了空间碎片减控的法律制度，阐述了空间碎片的危害性及其种类，对空间碎片减控法律制度的概念和特点作了总结，回顾了空间碎片减控法律制度的发展历程，最后分析了空间碎片减控法律制度确立的理论基础。 第二章对空间碎片减控的国际法规范进行了研究。对外空条约以及两个国际文件中有关空间碎片减控的内容进行了逐条分析，研究现有国际法体系下确立的空间碎片减控法律制度。 第三章选取了美国和俄罗斯两个空间大国作为研究对象，对其国内空间碎片减控法律制度的立法背景、立法过程及主要内容进行分析，并对两个国家国内空间碎片减控立法作出评析。 第四章是从我国应当如何完善空间碎片减控立法的立场思考，分析了我国现有空间碎片减控法律制度的不足，并提出了我国如何完善空间碎片减控法律制度的具体建议。 最后笔者通过结语对全文的观点进行归纳和总结。
[Abstract]:Since the space age began, Earth orbit has been used at high altitude. A large number of satellites have left a large amount of space debris in Earth's orbit, rendering some of the Earth's orbit ineffective. Unfortunately, there is still no specific international treaty regulating space debris. Although there are some technical standards that can mitigate the problem of space debris, in order to better protect the outer space environment, these technical standards need to be accompanied by a legal regime to effectively regulate the generation and mitigation of space debris. Starting from the meaning, characteristics, contents and theoretical basis of the legal system of space debris mitigation, this paper analyzes the deficiency of our country's legislation by studying the outer space treaty and the domestic space debris control laws of the United States and Russia. At the same time, some suggestions on how to perfect the legislation of space debris mitigation and control are put forward in order to make our country better fulfill its treaty obligations and protect the outer space environment. In addition to the preface and conclusion, this article is divided into four chapters. The first chapter summarizes the legal system of space debris mitigation and control, expounds the harmfulness and types of space debris, summarizes the concept and characteristics of the legal system of space debris mitigation and control, and reviews the development of the legal system of space debris mitigation and control. Finally, the theoretical basis of establishing the legal system of space debris mitigation and control is analyzed. The second chapter studies the international law norms of space debris mitigation. The contents of space debris mitigation and control in outer space treaties and two international documents are analyzed article by article, and the legal regime of space debris mitigation established under the existing international law system is studied. The third chapter selects the United States and Russia as the research object, analyzes the legislative background, the legislative process and the main content of the domestic space debris control legal system. And the domestic space debris control legislation of two countries to make an assessment. In the fourth chapter, from the standpoint of how our country should perfect the legislation of space debris mitigation and control, the author analyzes the deficiency of the existing legal system of space debris mitigation and control in China, and puts forward some concrete suggestions on how to perfect the legal system of space debris mitigation and control in our country. Finally, the author summarizes the views of the full text through the conclusion.
