北极航道“特殊条约规制型海峡模式”的治理与构建

【摘要】:北极航道特殊的地理条件,决定了依据《联合国海洋法公约》规定的不同海域制度实行分段适用制存在操作层面上的困难;各利益集团对北极航道的法律属性与法律权益存在的严重分歧,也决定了无法通过创制类似《南极条约》或《斯瓦尔巴德条约》的模式来治理北极航道。基于目前海事法律制度无法全面有效规制北极航道和设想的治理模式无法适用北极航道以及北极航道自身特征与"特殊条约规制型海峡治理模式"之间契合度的考虑,应当确立北极航道"特殊条约规制型海峡治理模式"。与其他特殊条约规制型海峡更多侧重军事舰机航行制度不同,北极航道"特殊条约规制型海峡治理模式"相关制度的构建至少包括北极航行申报制度、北极航行生态保护海事应急制度和海上事故或事件调查制度等。
[Abstract]:The special geographical conditions of the Arctic waterway make it difficult to implement the segmented application system according to the different sea area regimes stipulated by the United Nations Convention on the Law of the Sea (UNCLOS). The serious differences between the legal attributes and legal rights and interests of the Arctic Waterway also determine that it is impossible to create a model similar to the Antarctic Treaty or the Treaty of Svalbard to govern the Arctic Waterway. Based on the fact that the current maritime legal system cannot effectively regulate the Arctic Channel and the envisaged governance model, it is impossible to apply the Arctic Channel and the compatibility between the Arctic Channel's own characteristics and the "Special Treaty Regulation Channel Governance Model". It is necessary to establish the "special treaty regulation model of strait governance" in the Arctic waterway. Different from other special treaty regulation straits, the construction of the Arctic waterway "special treaty regulation strait governance mode" includes at least the Arctic navigation declaration system. Arctic navigation ecological protection maritime emergency system and marine accident or incident investigation system.
