蒙中双边贸易协定问题研究

【摘要】:摘要:双边贸易协定是两国家之间调整它们相互的经济贸易关系的一种书面协议。最近几年间,双边贸易协定如雨后春笋般发展起来,呈现出与以往不同的发展特点和趋势。目前,所有国家都希望通过国家和国际政策,鼓励双边贸易的扩大与多样化,发展货物与服务贸易,推动贸易自由化。许多国家消除双边贸易壁垒,便利缔约双方之间贸易的跨境流动,并放宽或取消对他们的行动限制。在90年代初,蒙古国也是开放经济,为了发展与鼓励蒙中双边贸易,签署双边贸易协定。然而,还没有任何国外及国内研究关于蒙外双边贸易协定。本文旨在概述现行蒙中之间的双边贸易协定及其法律问题,并探索如何加强两国之间的双边贸易协议。 就研究价值而言,本文是第一篇就所选题目进行论述的研究。本文主要以归纳分析与演绎分析相结合、实证分析与规范分析相结合的方法,比较了蒙中两国的经济贸易合作关系的特征、分析了蒙中双边贸易协定当中存在的问题,最后提出了加强和改善这个蒙中双边贸易协定的建议。并对未来两个国家将会签署的双边自由贸易协定进行了讨论。 第一部分简单总结了双边贸易协定的概念和新发展,主要是双边贸易协定的定义与特征,协定的内容结构,双边贸易协定的新发展。 第二部分简介蒙中双边贸易关系。尤其是,蒙古对外经贸战略,蒙古国经济近况与对外贸易,蒙中双边经贸发展及特点。 第三部分提出《蒙中双边贸易协定》的概况。涉及蒙中之间双边条约的产生,蒙中双边贸易协定签订背景,蒙中双边贸易协定的主要内容。 第四部分主要分析目前的蒙中双边贸易协定。作者认为,两国之间双边贸易协定上存在一些问题,需要完善。例如,现行的蒙中双边贸易协定没有定义与适用范围条款。另外,贸易待遇,贸易合作条款有关的问题必须需要改善。 第五部分主要讨论蒙中双边贸易协定完善及展望,提出重新修订存在的蒙中之间双边贸易协定的措施。譬如,该协定需要增加贸易待遇和完规定贸易协定的一些重要条款,建立贸易协定执行机制,批准需要的外贸易法。 随着两国合作领域的不断拓展,双方合作的法律环境这样不断完善,相信蒙中两国未来的经贸合作关系一定会健康、稳定地向前推进。
[Abstract]:Abstract: bilateral trade agreement is a written agreement between two countries to adjust their economic and trade relations. In recent years, bilateral trade agreements have sprung up, showing different characteristics and trends. At present, all countries hope to encourage the expansion and diversification of bilateral trade, develop trade in goods and services, and promote trade liberalization through national and international policies. Many countries remove bilateral barriers to trade, facilitate cross-border flows of trade between contracting parties, and relax or remove restrictions on their movement. In the early 1990s, Mongolia also opened its economy and signed bilateral trade agreements to develop and encourage bilateral trade between Mongolia and China. However, there is no foreign and domestic research on bilateral trade agreements between Mongolia and foreign countries. The purpose of this paper is to outline the current bilateral trade agreement between Mongolia and China and its legal problems, and to explore how to strengthen the bilateral trade agreement between the two countries. As far as the research value is concerned, this paper is the first to discuss the selected topics. By combining inductive analysis with deductive analysis, empirical analysis and normative analysis, this paper compares the characteristics of the economic and trade cooperation between Mongolia and China, and analyzes the problems existing in the bilateral trade agreements between Mongolia and China. Finally, suggestions for strengthening and improving the bilateral trade agreement between Mongolia and China are put forward. It also discusses the bilateral free trade agreements to be signed by the two countries in the future. The first part briefly summarizes the concept and new development of bilateral trade agreement, mainly the definition and characteristics of bilateral trade agreement, the content structure of bilateral trade agreement, and the new development of bilateral trade agreement. The second part introduces the bilateral trade relations between Mongolia and China. In particular, Mongolia's foreign trade strategy, Mongolia's economic situation and foreign trade, Mongolia and China's bilateral economic and trade development and characteristics. The third part puts forward the general situation of the bilateral trade agreement between Mongolia and China. It involves the emergence of bilateral treaties between Mongolia and China, the background of signing bilateral trade agreements between Mongolia and China, and the main contents of bilateral trade agreements between Mongolia and China. The fourth part mainly analyzes the current bilateral trade agreement between Mongolia and China. The author believes that there are some problems in bilateral trade agreements between the two countries, which need to be improved. For example, the current bilateral trade agreement between Mongolia and China has no definition and scope of application. In addition, trade treatment, trade cooperation terms related issues must be improved. The fifth part mainly discusses the perfection and prospect of bilateral trade agreement between Mongolia and China, and puts forward the measures to revise the existing bilateral trade agreement between Mongolia and China. For example, the agreement requires the addition of trade treatment and the completion of important provisions of trade agreements, the establishment of enforcement mechanisms for trade agreements, and the ratification of the required non-trade laws. With the continuous expansion of the fields of cooperation between the two countries and the continuous improvement of the legal environment for bilateral cooperation, it is believed that the economic and trade cooperation between Mongolia and China in the future will surely move forward healthily and steadily.
