论《开普敦公约》对我国民用航空设备租赁的影响
[Abstract]:In today's society, with the development of economic globalization, the trade and business exchanges of various countries in the world continue to increase, and as the main and preferred means of transportation for international transport, the air transport industry has been further developed. The demand for aircraft and aviation equipment is also increasing day by day in various industries. But aviation equipment is expensive, its high-cost, slow-return characteristics make the major airlines prefer to lease instead of purchase, aircraft financing lease has emerged as the times require. Aircraft financing lease, as a form of financing, can greatly ease the funding and cost constraints of airlines and help airlines to purchase the aviation equipment they need at lower prices, in order to expand the size and capacity of their companies. And then promote the prosperity of the aviation industry. At present, aircraft finance lease has been widely used all over the world, and inter-country aircraft lease needs corresponding international treaties to protect. Driven by concerted efforts by the International Civil Aviation Organization and the International Institute for the Unification of Private Law, which adopted the Convention on International interests in Mobile equipment and the Protocol to the Convention on International interests in Mobile equipment on specific issues relating to aircraft equipment, The (Cape Town Convention). Convention, collectively known as the Cape Town Convention, aims to establish a legal regime regulating the security, retention of title and tenancy interests of cross-border aviation equipment, while protecting the interests of the lessee. On 1 June 2009, the Cape Town Convention entered into force in our country, and this article will analyse the important provisions and basic principles of the Cape Town Convention, To explore its system of protection and relief in the field of aircraft financial lease, and to further discuss how to improve the relevant domestic laws and regulations after China's accession to the Cape Town Convention through the study of the mode of financial lease in all countries of the world, Based on this, the difference between domestic law and Cape Town Convention is solved, and the aircraft financing lease system in China is improved, and the development of aviation industry in China is promoted. This paper is divided into four parts. The first part mainly introduces the background and content of Cape Town Convention, analyzes its provisions regulating aircraft financial lease, and introduces the protection benefits that States parties can enjoy after joining the Convention. The second part will introduce the concept of aircraft financial lease and its related tradition, and analyze and compare the current situation and operation process of aircraft financial lease in the world. The third part introduces in detail the status of aircraft financial leasing in China, analyzes its advantages, shortcomings and deficiencies, and what impact it will have on China's financial leasing industry after the application of the Cape Town Convention. Focus on the positive impact and hindrance two aspects to carry on the analysis. The fourth part, on the basis of the first three parts, puts forward some suggestions for the future development of aircraft financing lease in China, in order to deal with the application of the Cape Town Convention and promote the early integration of domestic industries with international conventions. And summarize the relevant improvement measures and the construction of the corresponding legal protection system.
