危险货物海上跨界运输的沿海国管辖权

【摘要】：近年来,随着产业分工全球化,危险货物海上跨界运输已变得越来越普遍,于是出现了与此相关的一系列法律争议。从危险货物的法律性质出发,可以将危险货物分为禁止运输的危险货物、特殊危险货物、普通危险货物三类,分别讨论其对应的沿海国管辖权问题。针对不同种类的危险货物,沿海国应采取不同的管辖措施,严格管控禁止运输之危险货物的海上运输,规范针对运输特殊危险货物的事前告知制度,严格监督且加强对普通危险货物的海上跨界运输的管理。
[Abstract]:In recent years, with the globalization of industrial division of labor, the cross-border transport of dangerous goods by sea has become more and more common, so a series of related legal disputes have emerged. According to the legal nature of dangerous goods, dangerous goods can be divided into three categories: prohibited dangerous goods, special dangerous goods and ordinary dangerous goods, and the corresponding jurisdiction of coastal States can be discussed respectively. For different types of dangerous goods, coastal States shall take different jurisdiction measures, strictly control the maritime transport of prohibited dangerous goods, and standardize the system of prior notification for the transport of special dangerous goods, Strictly supervise and strengthen the management of the cross-border transport of ordinary dangerous goods by sea.
