世界银行采购政策中的利益冲突规则及我国相关立法借鉴

【摘要】：世界银行采购政策是一个包含了各种规范性文件在内的一揽子制度安排,对国际招投标法律制度产生了重要影响;利益冲突规则是其中一个重要的规则,主要包括三个方面:贷款项目咨询顾问聘请中的利益冲突规则、土建工程投标人的利益冲突规则和招标评标中的利益冲突规则;本文对前两个方面的利益冲突规则作了介绍和分析,并对我国相关立法如何借鉴该规则提出了若干建议。
[Abstract]:The World Bank's procurement policy is a package of system, including various normative documents, which has an important impact on the legal system of international bidding and tendering;Conflict of interest rules are one of the most important rules, mainly including the conflict of interest rules in the engagement of the project consultant, the conflict of interest rules of civil engineering bidders and the rules of interest in the bid evaluation;This paper introduces and analyzes the rules of conflict of interest in the first two aspects, and puts forward some suggestions on how to use the relevant legislation of our country.
