防空识别区制度研究

【摘要】:中国宣布设立东海防空识别之后,国内外社会对此关注密切。划设防空识别区,是平等主权国家之间的一项自然权利,也符合国际习惯的构成,自然得到了大多数国家的认可。中国在2013年才划设东海防空识别区,设立的时间较晚,实践经验不足。另外,中国周边国家防空识别区的范围远远大于其专属经济区上空空域,这样就会产生重合区域,容易引起摩擦和争端。如何和平共处、互利共赢便是一项值得探讨的重要议题。本文综合运用多种研究方法,对防空识别区的国际法原理以及相关国家的实践,进行较为深入的分析;对当今国家的防空识别区存在的问题进行了充分说明,特别是对中国防空识别区制度规则的设置,提出了具体可行的操作措施,使中国在解决防空识别区争端中有法可依、有理可据。本文针对防空识别区制度,从以下五方面进行分析研究。第一部分是对防空识别区的有关制度进行介绍。主要包括防空识别区的概念、特点以及与其他相关法律概念的联系与区别。第二部分是介绍防空识别区制度的产生、发展及存在的问题,对防空识别区的来龙去脉进行有效的梳理,进而指出当前防空识别区制度存在的不足之处。第三部分是分析防空识别区制度的国际法原理。包括防空识别区制度的理论与实践分歧,沿海国在本国防空识别区内享有的权利,防空识别区内适用的国际法原则。第四部分是通过对我国防空识别区制度的具体介绍,据此发现我国防空识别区存在的问题。第五部分是为我国防空识别区制度的完善提出合理化建议。包括建立健全相关法律制度,加强国际交流与合作。为了形成完善的防空识别区体系,更好维护国家安全,提出了划设南海防空识别区的构想。
[Abstract]:After China announced the establishment of air defense identification in the East China Sea, the domestic and foreign society paid close attention to this. The establishment of air defense identification zones is a natural right between equal and sovereign States, and it is also in line with the composition of international customs, and has naturally been recognized by most countries. China set up the East China Sea Air Defense Identification Zone only in 2013, which was set up late and inexperienced in practice. In addition, the scope of the air defense identification zone of China's neighboring countries is much larger than that over its exclusive economic zone, which will lead to overlapping areas and easy to cause friction and disputes. How to coexist peacefully and win-win is an important issue worthy of discussion. This paper makes a thorough analysis of the principles of international law of air defense identification zones and the practices of related countries by using various research methods, and fully explains the existing problems of air defense identification zones in today's countries, especially for the establishment of the system rules of China air defense identification zones, and puts forward concrete and feasible operational measures to make China have laws to follow and reasonable basis for the settlement of disputes over air defense identification zones. In this paper, the air defense identification zone system, from the following five aspects of analysis and research. The first part is the introduction of the relevant system of air defense identification zone. It mainly includes the concept and characteristics of air defense identification zone and the relationship and difference with other related legal concepts. The second part introduces the emergence, development and existing problems of the air defense identification zone system, effectively combs the background of the air defense identification zone, and then points out the shortcomings of the current air defense identification zone system. The third part is to analyze the principle of international law of air defense identification zone system. Including the theoretical and practical differences of the air defense identification zone system, the rights enjoyed by coastal countries in the national air defense identification zone, and the principles of international law applicable to the air defense identification zone. The fourth part is through the specific introduction of the air defense identification zone system in our country, according to which the problems existing in the air defense identification zone in our country are found. The fifth part is to put forward reasonable suggestions for the improvement of air defense identification zone system in China. Including the establishment and improvement of relevant legal systems, strengthen international exchanges and cooperation. In order to form a perfect air defense identification zone system and better maintain national security, the idea of setting up the South China Sea air defense identification zone is put forward.
