论网络虚拟财产的民事法律规制

【摘要】：人类似乎没有办法阻止互联网的发展了,网络技术的发展已经势不可挡,互联网中各种虚拟财产交易络绎不绝,成为一种新兴的产业。网络虚拟财产横空出世,作为一种全新的财产形态,其对源远流长的传统财产理论体系是一种巨大的挑战。我国大陆目前对于实体财产的保护趋于完善,但对于网络虚拟财产的民事法律规制却出现了断裂,现在处于断层状态。虽然通过中国网络虚拟财产第一案——李宏晨诉北极冰科技公司案后,在学术界掀起了对网络虚拟财产进行立法保护的大讨论,但至少目前,在民事领域内并未得到规制。本文以此为依据,希望在民事领域内调整,包括单独立法、用物权法、合同法、继承法制度等予以规制。随着网络逐步渗透到社会生活的方方面面,网络虚拟财产的价值性越来越受到重视。正视网络虚拟财产的现实性,并为其在这个社会的生根发芽以尽绵薄之力,这符合社会的经济发展及其顺应时代的潮流。网络虚拟财产是伴随着这个时代的脉搏而诞生,作为一个时代的符号,网络虚拟财产既有社会价值、经济价值还有情感价值。我们应该在理论上和实践中正确看待网络虚拟财产的合法性问题,将其纳入民事法律的构建内。本文除了结语,共四个部分构成,分别在下面做一简要概述：第一章是绪论,分别是从网络虚拟财产的研究背景、研究目的和意义、研究内容、研究方法四个方面来简要概述；第二章概述网络虚拟财产的法律特点和法律属性,分别从网络虚拟财产的概念、法律特点、法律属性这三个方面加以概述；第三章是网络虚拟财产民事法律保护的现实性和理论依据,分别从网络虚拟财产的保护是全社会的需求、网络虚拟财产发展迅速亟待保护、网络虚拟财产的规制是与国际接轨这三个方面加以论述；第四章是网络虚拟财产在民事法律领域内相关具体制度的构建与完善,分别从我国大陆地区目前对网络虚拟财产在民事领域内受到调整的现状分析、制定专门民事法律制度进行规制、运用物权法相关制度进行规制、运用合同法相关制度进行规制以及运用继承法相关制度进行规制这五个方面来论述。第四章是本文的重点,其中制定专门民事法律制度进行规制这一节中,在网络虚拟财产民事法律体系中构建报失保全制度和为网络虚拟财产设立鉴定机构,这是本文独具匠心的地方。结语是对文章中心的概括以及对网络虚拟财产能够尽快纳入我国现行民事法律调整的美好期待。
[Abstract]:The development of human beings seem to have no way to prevent the development of the Internet, network technology has been a trend which cannot be halted, Internet virtual property transactions of all kinds in a continuous line, has become an emerging industry. Virtual property was born, as a new form of property, which is a great challenge to the traditional theory of property system has a long history. I at present in China for the protection of the entity property tends to improve, but the civil law regulation of the virtual property have been broken, now in fault state. Although the Chinese network virtual property first case, Li Hongchen v. beijibing Technology Inc., launched a discussion of legal protection of virtual property in the academic circles, but at least now, did not get the regulation in the civil field. This paper on the basis of hope, adjustment in the civil field, including separate legislation, property Right law, contract law, inheritance law system should be regulated.
Along with the network gradually penetrated into all aspects of social life, the value of network virtual property has attracted more and more attention. To face the reality of the network virtual property, and for the rooting of this society to contribute the germination and development of social economy and conforms to the trend of the time. The network virtual property is accompanied by the the pulse of the times and the birth, as a symbol of the era, the network virtual property has both social value, economic value and emotional value. We should correctly treat the legitimacy of network virtual property in theory and practice, will be incorporated into the construction of civil law.
In addition to this conclusion, a total of four parts, respectively, to do a brief overview below:
The first chapter is the introduction, which is from the research background of network virtual property, the research purpose and significance, research contents, research methods to four aspects: a brief overview of the legal characteristics and legal attribute; the second chapter summarizes the network virtual property, respectively, from the concept of network virtual property legal characteristics, summarizes the three aspects of legal attribute; the third chapter is the civil law protection of network virtual property in reality and theoretical basis, respectively, from the protection of virtual property is the demand of the whole society, the rapid development of the urgent need to protect the network virtual property, virtual property regulation is to discuss these three aspects in line with international standards; the fourth chapter is the construction and perfection of network virtual property the relevant specific system in the civil law field, respectively, from mainland China at present on the network virtual property by adjusting the current situation in the civil field analysis, formulation The regulation of civil special legal system, regulate the use of the property law system, use of contract law system of regulation as well as the use of inheritance to discuss the regulation of these five aspects of law. The fourth chapter is the focus of this paper, including the development of special civil legal system of regulation in this section, the construction and the establishment of missing preservation system the accreditation body for the network virtual property in the civil law system of network virtual property, this is the place. The conclusion is to have great originality in the center and the general of the virtual property as soon as possible into a beautiful look of China's current civil legal regulation.
