论信赖利益的损害赔偿范围及其限制

【摘要】：信赖利益损害赔偿制度是基于民法诚实信用原则与社会信用的扩张而设立的。我国立法应对信赖利益的损害赔偿范围进行明确的界定。信赖利益的损害赔偿范围包括间接财产损失与非财产损害,且损害赔偿范围受履行利益以及《合同法》上相关规则的限制。
[Abstract]:The compensation system of trust benefit is established based on the principle of honesty and credibility of civil law and the expansion of social credit . Our legislation should clearly define the scope of compensation for the benefit of compensation . The scope of damage compensation includes indirect property loss and non - property damage , and the scope of damage compensation is limited by the performance benefits and the relevant rules in the contract law .
