对我国劳务派遣立法发展趋势的思考

【摘要】:劳务派遣是一种涉及三方主体,以“雇用”和“使用”相分离为最主要特征的新型用工形式,是近几年我国劳动法领域学术研究的热点。从劳动合同法颁布实施4年多来的实际效果看,我国劳务派遣用工规模总量呈现出“不降反升”的态势,与立法者的预期截然相反,这是我国进一步加强其法律规制的主要动因。2012年6月,劳动合同法修正案草案向社会公开征求意见,在短短一个月内,收到各方意见55万条,创造了我国法律公开征求意见之最,使劳务派遣的存废之争再度引起热议。笔者以此次劳动合同法修法为切入点,通过修法之争、理论学说、国内发展回顾、国际经验借鉴和立法建议等五个章节的论述,尝试为我国劳务派遣立法提供一种不同于主流观点的思考视角和路径。本文第一章从劳动合同法修法之动因、焦点和争论三个方面引出对劳务派遣立法问题的讨论和思考;第二章通过介绍劳务派遣的法律特征、劳动关系和社会功能等三个主要学说,为进一步开展观点论证提供理论依据;第三章通过研究1995年至今各类相关文献评论和研究主题、观点的变化,总结我国劳务派遣的发展阶段和轨迹,并以此为思考主线,引出政府、工会、国企三个在我国劳务派遣发展过程中最为重要的主体角色,并开展三者之间的立法博弈分析,同时以劳务派遣社会功能的发挥为归宿,尝试提供一种不同的思考视角和路径;第四章介绍了国际上主要国家劳务派遣的发展规模、轨迹和特点等,并从发展趋势、总体规模、规制方式等三个方面简单进行了国际经验的比较和借鉴,得出劳务派遣用工形式在国际上正处于“发展”而非“消亡”阶段的结论,成为我国继续发展劳务派遣的国际背景;第五章则在前面各章研究分析的基础上提出了“一降一升”的立法建议,“降”是指通过调整劳动合同法中的“无固定期限劳动合同”、“法定解除制度”等,降低目前标准劳动关系的刚性,,减小劳动用工从标准劳动关系向劳务派遣转移的冲动;“升”是指放弃目前劳务派遣立法所采用的限制范围为主的方式,以双重劳动关系共同雇主理论为依据,通过合理的雇主责任分配来提高劳务派遣用工的规范性。
[Abstract]:Labor dispatch is a new type of employment which involves three parties and is characterized by the separation of "employment" and "use". It is a hot topic in the field of labor law of our country in recent years. From the actual effect of the promulgation and implementation of labor contract law for more than four years, the total scale of labor dispatch in our country shows the trend of "not decreasing but rising", which is contrary to the expectation of the legislator. This is the main reason for our country to further strengthen its legal regulation. In June 2012, the draft amendment to the Labor contract Law was open to the public for comments. Within a short period of one month, 550000 opinions were received from all parties. It has created the most open solicitation for opinions of our country's law, and caused the controversy of labor dispatch to save and abolish again. The author regards this labor contract law as the starting point, through the dispute of amending law, theory theory, domestic development retrospect, This paper tries to provide a different angle of view and path for China's labor dispatch legislation from the perspective of international experience and legislative suggestions. The first chapter of this paper is the motivation of the revision of labor contract law. The second chapter introduces the legal characteristics of labor dispatch, labor relations and social functions. The third chapter summarizes the development stage and track of labor dispatch in our country through the study of various related literature reviews and research themes and changes of viewpoints from 1995 to now, and takes this as the main line of thinking. Leading to the government, trade unions, state-owned enterprises in the development of labor dispatch in the process of the most important main role, and carry out the legislative game analysis between the three, at the same time, the social function of labor dispatch as the end-result, The fourth chapter introduces the development scale, track and characteristics of labor dispatch from the main countries in the world, and from the development trend, the overall scale. Three aspects of regulation and regulation are compared and used for reference, and the conclusion that the employment form of labor dispatch is in the stage of "development" rather than "extinction" in the world becomes the international background for our country to continue to develop labor dispatch. The fifth chapter, on the basis of the previous chapters' research and analysis, puts forward the legislative proposals of "one drop and one litre". "drop" refers to the "indefinite labor contract" and the "statutory rescission system" by adjusting the labor contract law. Reducing the rigidity of current standard labor relations and reducing the impulse to transfer labor employment from standard labor relations to labor dispatch. Based on the theory of dual labor relations, the standard of labor dispatch is improved by reasonable distribution of employer's responsibility.
