家教服务合同的性质及其责任研究

【摘要】:家教市场的繁荣使得实践中的家教纠纷日益增多,但是我国却没有相应的法律规定进行规制,出现了理论与实践脱节的情形。本文从合同法角度对家教服务进行研究,我国大多是从教育学的角度对家教服务进行理论研究,学者周江洪在对服务合同的研究中提到,服务合同是一种无名合同,但在我国合同法中没有明确的规定,家教服务合同作为一种服务合同,从字面意思上理解,是一种提供家教服务的合同,它的标的是传授知识和学习方法。 本文对家教服务合同进行研究,首先是家教服务合同的概述,界定了家教服务合同的称谓,内涵及其特征。其次是家教服务合同的性质,本文通过家教服务合同与委托合同,承揽合同和雇佣合同进行辨析阐明了家教服务合同的一般性质,接着通过家教服务合同与教育合同和教育培训合同的辨析说明了其特殊性质。最后是家教服务合同的责任,家教服务合同由于其特殊性,分为两个阶段:试讲阶段和授课服务阶段,根据其这一特殊性,大胆的将其责任分为试讲阶段的责任和授课服务阶段的责任,分别进行了分析。 本文主要运用的研究方法有:首先,调查分析研究。现实生活中的家教服务进行调查研究以及自己家教的经验,对家教服务合同进行了界定和性质分析。其次,比较分析研究。对家教服务合同的一般性质进行界定时,把它跟委托合同、承揽合同以及雇佣合同进行了比较,对其特殊性质进行界定时,把家教服务合同与教育合同、教育培训合同进行了比较。再次,学科交叉研究。本文的着眼点市从合同法的角度来研究家教服务,但是家教服务会涉及到社会学、教育学的内容,所以,法学和社会学、教育学相互结合是本文的必须要遵循的视角。 本文主要创新点如下:首先,研究角度的创新。我国对家教服务的理论研究侧重在教育学方面,鲜有学者从法律角度对其进行研究,而本文从合同法的角度对家教服务进行了分析,以期对实践中出现的家教服务纠纷有所规制。其次,研究内容的创新。根据家教服务责任的特殊性,将其责任分为试讲阶段的责任和授课服务责任,并分别进行了分析。 本文通过对家教服务合同的分析研究,得出了家教服务合同的内涵,性质,试讲阶段的责任和授课服务瑕疵的责任,以期使实践中出现的家教服务纠纷得到解决,家教市场得到规制。
[Abstract]:The prosperity of the family education market makes the practice of family education disputes increasing day by day, but our country does not have the corresponding laws and regulations to regulate, appeared the theory and the practice disjointed situation.This paper studies the family education service from the angle of contract law. In our country, it is mostly from the angle of pedagogy. The scholar Zhou Jianghong mentioned in his research on service contract that service contract is a kind of nameless contract.However, there is no clear stipulation in the contract law of our country. As a service contract, tutoring service contract, taken literally, is a kind of contract to provide tutoring service, the object of which is to impart knowledge and study methods.This paper studies the family education service contract, first of all, the outline of the family education service contract, defines the title, connotation and characteristics of the family education service contract.Secondly, it is the nature of the family education service contract. Through the family education service contract and the entrustment contract, this paper analyzes the general nature of the family education service contract, including the contract of contracting and the contract of employment.Then, it explains its special nature by discriminating between tutor service contract and education contract and education training contract.Finally, it is the responsibility of the tutoring service contract. Because of its particularity, the tutor service contract is divided into two stages: the trial lecture stage and the teaching service stage, according to this particularity,The responsibility is divided into trial stage responsibility and lecture service stage responsibility, respectively.The main research methods used in this paper are as follows: first, investigation and analysis.This paper makes an investigation and research on the tutoring service in real life and its own experience, and defines the contract of the tutoring service and analyzes the nature of the contract.Secondly, comparative analysis and research.When defining the general nature of the family education service contract, the author compares it with the entrustment contract, the contract of contracting and the contract of employment. When defining the special nature of the contract, the contract of home education service is compared with the contract of education.Education and training contracts are compared.Thirdly, interdisciplinary research.This paper focuses on the study of tutor service from the angle of contract law, but it will involve the contents of sociology and pedagogy. Therefore, the combination of law, sociology and pedagogy is the angle of view that this article must follow.The main innovation points of this paper are as follows: first, research angle innovation.In our country, the theoretical research on the family education service is focused on the pedagogy, few scholars study it from the angle of law, and this article analyzes the family education service from the angle of contract law.With a view to the practice of tutoring service disputes have regulations.Secondly, the innovation of research content.According to the particularity of tutoring service responsibility, the responsibility is divided into trial stage responsibility and teaching service responsibility, and analyzed separately.Based on the analysis and study of the tutor service contract, this paper concludes the connotation and nature of the family education service contract, the responsibility of the trial teaching stage and the responsibility of teaching service defect, in order to resolve the disputes of the family education service in practice.The tutoring market is regulated.
