船员工资报酬之船舶优先权问题研究

【摘要】:本文的研究对象为船员工资报酬之船舶优先权,提出了实践中船员在实现船舶优先权过程中的主要法律问题与争议,通过比较法学、法解释学、法经济学等分析方法分析了其原因,并初步提出了每个问题的解决方案以及对立法完善的若干建议。本文除引言和结论外,正文包括四章内容。第一章为船员工资报酬之船舶优先权的概述。首先,论述了对船员工资报酬赋予船舶优先权的重要性,即由于船员劳动的特殊性与风险性以及其弱势群体的地位,船员工资报酬成为了优先中的优先。其次,笔者论述了有关船员工资报酬之船舶优先权的立法规制现状与司法实践现状,结合二者提出了船员在实现船舶优先权过程中所遇到的主要法律问题。第二章论述了船员工资报酬之船舶优先权的权利主体。笔者分析了船员工资报酬之船舶优先权的原始主体以及继受主体,在原始主体方面主要讨论了判断船员主体的标准究竟为在船服务还是签订劳动合同,以及不适任船员能否成为船员工资报酬之船舶优先权的主体。在继受主体方面,笔者分析了具有人身专属性质的船员工资报酬之船舶优先权能否继受取得的问题。第三章论述了船员工资报酬之船舶优先权义务主体的认定,着重分析了船员外派下船东已将工资报酬支付给外派机构后,船员能否向其主张船舶优先权,以及此时船员工资报酬之船舶优先权义务主体的认定。第四章论述了船员工资报酬优先权所担保的债权范围,主要聚焦于《劳动合同法》下的双倍工资以及"禁渔期"的工资报酬能否受船舶优先权的担保这两大问题。
[Abstract]:The research object of this paper is the maritime liens of crew wages and remuneration, and puts forward the main legal problems and disputes in the process of realizing maritime liens in practice. Through comparative jurisprudence, legal hermeneutics, The analysis methods of law and economics have analyzed the reasons and put forward the solutions to each problem and some suggestions on the perfection of legislation. In addition to the introduction and conclusions, the text includes four chapters. Chapter one is an overview of maritime liens of crew wages and remuneration. Firstly, the importance of giving ship lien to crew pay is discussed, that is, because of the particularity and risk of crew labor and the status of vulnerable group, crew pay becomes the first priority. Secondly, the author discusses the current legislative regulation and judicial practice of the maritime liens concerning the crew wages and remuneration, and puts forward the main legal problems encountered by the crew in the process of realizing the maritime lien. The second chapter discusses the subject of ship lien of crew wages and remuneration. The author analyzes the original subject and the secondary subject of the ship lien of the crew wages and remuneration. In the aspect of the original subject, the author mainly discusses whether the standard of judging the crew main body is the service in the ship or the signing of the labor contract. And whether the unfit crew can become the main body of the ship's priority of the crew's wages and remuneration. In the following subject, the author analyzes whether the maritime liens with personal exclusive remuneration of crew wages can be succeeded. The third chapter discusses the determination of the subject of maritime lien obligation of crew wages and remuneration, and analyzes emphatically whether the crew members can claim maritime lien after the shipowner has paid the wages and remuneration to the dispatched organization. And at this time crew wages and remuneration of maritime lien obligations of the main body. The fourth chapter discusses the scope of claims guaranteed by the priority of crew remuneration, mainly focusing on the double wages under the Labor contract Law and whether the wages and remuneration during the "closed fishing period" can be secured by the maritime lien.
