从外商代表处用工看劳务派遣背后的制度冲突

【摘要】:2012至2013年间,国家相继出台《劳动合同法修正案》、《关于审理劳动争议件适用法律若干问题的解释(四)》(以下简称《司法解释四》)以及《劳务派遣若干规定(征求意见稿)》(以下简称《若干规定》)等多个劳动相关立法,意在进一步整治劳动力市场,尤其是劳务派遣。巧合的是,三部法案都直接或者间接涉及外商代表处用工,并在“究竟是否应当赋予外商代表处直接用工权?”,“外商代表处的劳务派遣是否应当纳入三性规范中去?”等问题的决断上反复纠结,其中映射出劳务派遣问题之复杂、立法者的意图与劳动力市场之间的角力。 本文从“外商代表处用工”这一问题作为切入点,通过对于“是否赋予外商代表处直接用工权”的可行性分析,探究了最高院在立法时的思维转变。同时,从国内、国外两个视角,结合历史和现状两个维度,多方位对比后反思我国现有劳务派遣相关规定的思维盲区。最终得出结论,我国的劳务派遣的形成原因、应用现状均与国外的劳务派遣模式存在较大差异,简单套用国外劳务派遣的“三性”理念,意在管控目前失控的劳务派遣市场只能适得其反。只有意识到劳务派遣背后的制度冲突,理顺从计划经济向市场经济转轨的一系列关系和矛盾,放松对劳务派遣目前的行政管制,劳动力市场才会自行调节消化各种不适,最终走向理性和健康。 本文除导言及结语外,共分五章,,概括如下: 第一章通过分析在《司法解释四》正式出台前后,最高院对于是否赋予外商代表处直接用工权问题上的反复,透过现象探究出了最高院从观念逻辑回归现实逻辑的思维转变。 第二章分别通过国内、国外两个视角,回顾我国劳务派遣的起源,探索劳务派遣在国外的产生与特征。通过两个视角的对比,反思了我国目前对于劳务派遣管理的思维盲区。 第三章聚焦目前被社会诟病最多的国有企业劳务派遣,深入研究其内部形成原因,外部的行政管制,以及劳务派遣背后的制度冲突。 第四章通过借鉴美国、日本两国对于劳务派遣的治理思路,提炼出值得我国学习的管理经验。 第五章展望未来,期望政府能够尽早停止过度干预,适当放松管制,才是还原劳动力市场正常秩序的唯一出路。
[Abstract]:Between 2012 and 2013, The State has successively promulgated the Amendment to the Labor contract Law, the interpretation of certain issues concerning the applicable Law of handling Labor disputes (4) > (hereinafter referred to as the Judicial interpretation IV) and the provisions on the dispatch of Labor Services (draft for soliciting opinions) (as follows) (referred to as "some provisions") and other labor-related legislation, Intends to further renovate the labor market, especially the labor dispatch. Coincidentally, the three bills directly or indirectly involve the employment of foreign representative offices, and "should the right of direct employment of foreign representative offices be granted?" and "should the labor dispatch of foreign representative offices be included in the three kinds of regulations?" It reflects the complexity of the issue of labor dispatch and the struggle between the legislator's intention and the labor market. Based on the analysis of the feasibility of "whether to grant the foreign representative office the right of direct employment", this paper probes into the change of thinking of the Supreme Court in the legislative process from the point of view of the issue of "employing foreign representative office" as a starting point. At the same time, from the two perspectives of domestic and foreign, combined with the two dimensions of history and present situation, this paper reflects on the thinking blind zone of the related regulations of labor dispatch in our country after multi-directional comparison. Finally, it is concluded that the reasons for the formation and application of labor dispatch in China are different from those in foreign countries, and the concept of "three properties" of labor dispatch abroad is simply applied. Attempts to control the currently out-of-control labor dispatch market are counterproductive. Only by realizing the institutional conflicts behind the dispatch of labor services, straightening out a series of relations and contradictions in the transition from a planned economy to a market economy, and relaxing the current administrative control over the dispatch of labor services, can the labor market adjust and digest all kinds of discomfort on its own, Finally, toward rationality and health. In addition to the introduction and conclusion, this paper is divided into five chapters, which are summarized as follows: The first chapter through the analysis before and after the "Judicial explanation IV" formally issued, the Supreme Court of whether to grant the foreign representative office of direct employment rights repeatedly, through the phenomenon to explore the Supreme Court from the concept of logic back to the reality of the logic of thinking. The second chapter reviews the origin of labor dispatch in China from two perspectives of domestic and foreign, and explores the origin and characteristics of labor dispatch in foreign countries. Through the comparison of two angles of view, this paper reflects on the blind zone of thinking about labor dispatch management in our country at present. The third chapter focuses on the labor dispatch of state-owned enterprises, which has been criticized most by the society at present, and deeply studies the causes of its internal formation, the external administrative control, and the institutional conflicts behind the labor dispatch. The fourth chapter abstracts the management experience of our country through drawing lessons from the management ideas of the United States and Japan for labor dispatch. The fifth chapter looks forward to the future and expects the government to stop excessive intervention as soon as possible and to relax its control properly, which is the only way to restore the normal order of the labor market.
