劳动先合同义务的法律缺失及制度建构

【摘要】:正在讨论中的《劳动合同法》(草案)第8条首次在立法中明确劳动先合同义务,无疑具有历史进步性,应予以肯定。但它基本上是民事先合同义务的劳动合同化,因为我国现阶段劳动关系的特殊性,此规定在实践中可能会使原已失衡的劳动关系更不平等。本文试图从劳权的立场出发,比较劳动与民事先合同义务,探讨劳动先合同义务的特殊性,建构我国劳动先合同义务制度。
[Abstract]:Article 8 of "Labor contract Law" (draft), which is under discussion, makes clear the obligation of labor first contract in legislation for the first time, which undoubtedly has historical progress and should be affirmed. But it is basically the labor contract of the people's prior contract obligation, because of the particularity of the labor relation at present in our country, this stipulation may make the already unbalanced labor relation more unequal in practice. From the standpoint of labor right, this paper attempts to compare the prior contract obligation between labor and the people, to discuss the particularity of labor prior contract obligation, and to construct the system of labor prior contract obligation in our country.
