【摘要】：民间借贷是一种古老的融资方式，在其漫长的发展历史中，既有过高峰也经历过低谷。随着社会主义市场经济的不断发展，民间借贷游离于我国现行金融体制之外，以惊人的速度日益壮大。它犹如一把“双刃剑”，一方面作为正规金融的有益补充，满足了多层次的市场资金需求，尤其对中小企业的发展具有重要作用；另一方面又由于其的自发性，，立法、监管等方面的缺位，缺乏外部约束与制度支撑，给金融稳定和市场经济的平稳运行带来了潜在的危险。近年来，借助于丰富的“羊、煤、土、气”资源，内蒙古自治区鄂尔多斯地区经济的快速发展，但在经济快速发展的同时，由于我国金融体制和机制种种限制的缘故，当地的民间借贷活动日益频繁，并已成为当地主要的融资手段。可以说，鄂尔多斯地区的民间借贷是我国目前民间金融发展状况的一大典型。不断蓬勃发展的民间借贷市场，给正规金融市场注入了一股活力，对于鄂尔多斯地区非公有制经济的发展有着不可替代的作用。在法律管制缺位和当地经济形势下滑的现状下，因其的自发性、隐蔽性以及对信用保障机制的过于依赖，导致鄂尔多斯地区的民间借贷问题重重，借贷利率一路飙升，高利转贷、以贷还贷以及民间金融机构违规操作现象普遍存在，在一定程度上加速了当地经济滑铁卢。目前，我国并没有一套完整的法律体系对民间借贷进行保护与限制，仅是在《民法通则》、《合同法》等法律法规中对其有一些原则性规定，过于笼统。因此，建立与完善我国民间借贷法律制度和监管体制显得尤为重要。本文从内蒙古鄂尔多斯地区民间借贷现状和困境分析入手，分析研究当地民间借贷的独有特点及社会影响力，进而提出在市场经济条件下对民间借贷进行有重点规制之建议，以求最大限度地维护债权人的债权和保护债务人的人身财产权利。
[Abstract]:Private lending is an ancient financing method. In its long history, it has experienced both peaks and valleys. With the continuous development of socialist market economy, private lending outside the current financial system of our country, growing at an alarming speed. It is like a "double-edged sword", on the one hand, as a useful supplement to the formal finance, it meets the multi-level market capital demand, especially for the development of small and medium-sized enterprises; on the other hand, because of its spontaneity, it legislates. The absence of supervision, lack of external constraints and institutional support brings potential risks to financial stability and smooth operation of market economy. In recent years, with the help of abundant "sheep, coal, soil and gas" resources, the economy of Erdos region in Inner Mongolia Autonomous region has developed rapidly, but at the same time, due to various constraints of China's financial system and mechanism, Local private lending activities are increasingly frequent, and has become the main local financing means. It can be said that private lending in Ordos region is a typical example of the development of private finance in China. The booming private lending market has injected a vitality into the formal financial market, which plays an irreplaceable role in the development of non-public ownership economy in Ordos region. Because of its spontaneity, concealment and too much reliance on the credit guarantee mechanism, due to the absence of legal control and the sliding local economic situation, the folk borrowing problem in Ordos region is full of problems, and the borrowing interest rate has soared all the time. The phenomenon of usury, loan repayment and non-government financial institutions' illegal operation has accelerated the local economy to a certain extent. At present, our country does not have a set of complete legal system to protect and restrict the folk loan, only in "Civil Law General principles", "contract Law" and other laws and regulations have some principle stipulation, it is too general. Therefore, it is very important to establish and perfect the legal system and supervision system of non-government loan in our country. This paper begins with the analysis of the current situation and predicament of folk lending in Ordos region of Inner Mongolia, analyzes and studies the unique characteristics and social influence of local folk lending, and then puts forward some suggestions on how to regulate folk lending under the market economy conditions. In order to maximize the protection of creditor's rights and the protection of the debtor's rights of life and property.
