劳务派遣法规与实际的落差

【摘要】：《劳动合同法》施行以来,对推动劳动者就业发挥了积极的作用,但同时也出现了一些问题,特别是劳务派遣法规与实际落差较大,法规是想保护被派遣劳动者合法权益,实际却是被派遣劳动者合法权益受到了损害。本文从相关法律条文争议;劳务派遣单位与用工单位利益驱使;相关部门监管等方面分析了落差形成原因,提出了加强新劳务派遣法规的宣传贯彻;抓紧制定与新劳务派遣法规配套的管理规定;进一步明确"三性"岗位;逐年制定整改目标;加大检查与处罚力度等方面提出了消除落差的建议。这些建议对于新劳务派遣法规的贯彻执行、维护被派遣劳动者合法权益、倡导公平公正的劳动制度与用工方式、构建和谐劳动关系、保持社会稳定与经济持续健康发展有积极意义。
[Abstract]:Since the implementation of the Labor contract Law, it has played a positive role in promoting the employment of workers, but at the same time, there have also been some problems, especially the large gap between the labor dispatch laws and the actual ones, which aims to protect the legitimate rights and interests of dispatched workers. In fact, the legitimate rights and interests of dispatched workers have been compromised. This paper analyzes the reasons of the gap from the aspects of the disputes of relevant laws and regulations, the interests of labor dispatch units and employment units, and the supervision of relevant departments, and proposes to strengthen the publicity and implementation of the new labor dispatch laws and regulations. Some suggestions are put forward to eliminate the gap in the following aspects, such as formulating management regulations that are in line with the new labor dispatch laws and regulations; further clarifying the "three sex" posts; making rectification and reform goals year by year; increasing inspection and punishment. These suggestions implement the new labor dispatch laws and regulations, safeguard the legitimate rights and interests of dispatched workers, advocate fair and just labor system and employment methods, and build harmonious labor relations. Maintaining social stability and sustained and healthy economic development is of positive significance.
