医疗事故中侵权责任与违约责任的竞合问题

【摘要】：侵权责任与违约责任只有在符合特定情形下才有可能发生况合,在医疗事故中,二者有发生况合的可能。处理侵权责任与违约责任之竞合的模式主要包括允许竞合模式、限制的选择诉讼的模式、补充救济模式,这些模式亦可用于医疗事故中权责任与违约责任竞合之处理。当前我国对医疗事故中的责任竞合采用的是允许竞合模式。就医疗事故责任竞合之处理,我国应当建构起补充救济模式,并修改民法通则、合同法的规定,在合同法、侵权责任法中建构起这一处理二者竞合的机制。
[Abstract]:Tort liability and breach of contract liability can only happen in accordance with the specific circumstances, in the medical accident, they have the possibility of deterioration. The modes of dealing with the concurrence of tort liability and breach liability mainly include the mode of allowing concurrence, the mode of limited choice of litigation, the mode of supplementary relief, which can also be used to deal with the concurrence of right liability and breach liability in medical accident. At present, the mode of liability concurrence in medical malpractice is permitted in our country. To deal with the concurrence of medical malpractice liability, our country should construct a supplementary relief mode, and revise the general rules of civil law and the provisions of contract law, and construct a mechanism to deal with the concurrence of the two in the law of contract law and tort liability law.
