舒某与华康公司工伤损害赔偿纠纷案评析

【摘要】:近年来,劳动者由于工伤引发的工伤损害赔偿纠纷成为了民事审判的热点和难点问题,引起了社会各界的广泛讨论。工伤案件中,劳动者与用人单位之间存在事实劳动关系,但并未签定书面劳动合同,在此种情形下,对事实劳动关系的认定,对劳动者合法权益之保障尤为重要。2008年的《劳动合同法》对事实劳动关系的保护进行了强化,但事实劳动关系在审理争议案件时仍然很难认定。本案中,有证据支撑的事实劳动关系是构成工伤损害赔偿的重要事实依据,而工伤损害赔偿的雇方承担无过错赔偿责任是确定赔偿的重要法律依据。但是,由于法律界定范围上的模糊性,受伤的劳动者与用人单位就赔偿的条件及依据也差生较大的分歧,在本案中雇方是否应承担全责也是双方当事人争议焦点之一。本案亦涉及到工伤赔偿协议的效力问题,即涉案当事人与用人单位经过协商就用人单位给予劳动者补偿的问题已签署的协议,当劳动者发生工伤后,大部分受伤的劳动者都选择与用人单位签订和解协议。一方面,可以避免双方就此事过多纠缠;另一方面,在双方都自愿签订和解协议的情况下,劳动者能较快拿到相应的赔偿。但是,如果用人单位未按照劳动者的伤残等级进行赔偿,在劳动者不清楚相关法律规定的情况下,所获得的赔偿很可能低于法定的赔偿数额。对于这种私了工伤协议性质及其效力范围究竟应当如何界定。依结合民法中的《合同法》和《劳动法》做具体分析。针对上述争议焦点,,司法实践中仍存在着一定的分歧。为了在司法实践中更好地处理工伤认定和赔偿问题,针对现实案例,有必要澄清法律认识上的误区,提出针对性的处理方法,以期保护劳动者的合法权益,稳定和改善劳动关系,维护司法公正。
[Abstract]:In recent years, disputes over compensation for industrial injury caused by industrial injury have become a hot and difficult issue in civil trials, which has aroused extensive discussion in various circles of society. In 2008, the Labor Contract Law strengthened the protection of factual labor relations, but it is still difficult to identify factual labor relations in the trial of disputed cases. However, due to the ambiguity of the scope of legal definition, the injured worker and the employing unit also differ greatly in terms of the conditions and basis for compensation. In this case, whether the employer should bear full responsibility is also one of the controversial focuses of both parties. It involves the validity of the agreement on compensation for work-related injuries, that is, the agreement signed between the parties involved and the employing unit after consultation on compensation for the employing unit. When the worker suffers from work-related injuries, most of the injured workers choose to sign a settlement agreement with the employing unit. On the one hand, the parties concerned can avoid too much entanglement about this matter. On the other hand, if the employer fails to compensate according to the disability level of the laborer, the compensation may be lower than the legal amount of compensation if the laborer is not clear about the relevant legal provisions. In order to better deal with the problem of identification and compensation of industrial injury in judicial practice, it is necessary to clarify the law in view of actual cases. In order to protect the legitimate rights and interests of laborers, stabilize and improve labor relations and safeguard judicial justice, this paper puts forward some methods to deal with the misunderstandings in legal cognition.
