常德市财政拨款单位临时聘用人员管理问题研究

【摘要】:临时聘用是就业的重要形式,临时聘用人员广泛存在于世界各国政府部门机构等公共部门之中。规范临时聘用人员的管理,是保障劳动者权益的重要方面,也是减少用人单位法律风险的重要途径。从国际层面看,临时聘用这种就业方式的存在,有效地缓解了社会就业压力,,对劳动力市场的发展和社会稳定均产生了积极作用,得到了国际组织和国外政府的广泛认可、保护和支持。国际劳工组织通过公约和建议书保护临时聘用人员的工资待遇、社会福利等切身利益,并在许多国家开展项目对其进行扶助。从国内层面看,随着经济和社会的飞速发展,我国各级政府部门的工作量成倍增长,人员需求量也不断增加。为了控制在编人数,节约人工成本,政府部门使用了大量临时聘用人员从事临时性、辅助性的事务工作。此类人员来源广泛,聘用形式也多种多样,导致劳动关系日趋多样化、复杂化,因劳动争议引发的群体性事件的上升趋势也愈发明显。《中华人民共和国劳动合同法》颁布实施后,对劳动者的合法权益给予了更充分、更全面的保护,对用人单位设置的禁止性或约束性规定使政府部门面临着劳动力成本进一步攀升、劳动合同风险进一步加剧的严峻形势。为此,深圳、扬州、岳阳等地率先探索解决政府部门临时聘用人员规范管理的问题,取得了不少可供借鉴的经验和成效。 本文在借鉴国际国内临时聘用人员管理经验的基础上,对如何规范湖南省常德市财政拨款单位临时聘用人员管理进行了研究。首先,本文介绍了研究背景和研究意义,评述了国内外研究现状,简述了研究内容和研究方法。其次,本文对临时聘用人员、财政拨款单位、编制等重要概念进行了阐述性说明,对相关基础理论进行了归纳和分析,并论述了现时规范财政拨款单位临时聘用人员管理的必要性。再次,根据实际调研汇总得来的数据和情况,综合归纳了常德市财政拨款单位临时聘用人员的管理现状,在临时聘用人员管理上仍存在的主要问题,以及这些问题产生的原因。又次,论文总结了国内先进地区规范财政拨款单位临时聘用人员管理的经验及其对常德市可能的借鉴。最后,在理论分析和实践经验的基础上,提出了规范常德市财政拨款单位临时聘用人员管理的若干政策性建议。笔者通过对这个主题所进行的研究,希望能够有助于推动理论研究者对规范政府部门等公共机构临时聘用人员管理的问题做出更深入的研究,也希望可以为常德市政府规范财政拨款单位临时聘用人员管理工作提供有价值的政策建议,同时也为其他地区提供值得借鉴的经验。
[Abstract]:Temporary employment is an important form of employment. Standardizing the management of temporary hires is not only an important aspect of protecting workers' rights and interests, but also an important way to reduce the legal risks of employers. From the international level, the existence of temporary employment has effectively alleviated the pressure of social employment, has played a positive role in the development of the labour market and social stability, and has been widely recognized by international organizations and foreign governments. Protection and support The ILO has adopted conventions and recommendations to protect the immediate interests of temporary hires, such as wage and social benefits, and to carry out projects to assist them in many countries. From the domestic level, with the rapid development of economy and society, the workload of government departments at all levels in China has increased exponentially, and the demand for personnel has also been increasing. In order to control the number of staff, save labor costs, government departments use a large number of temporary employment personnel for temporary, auxiliary work. Such personnel come from a wide range of sources and are employed in a variety of ways, leading to the increasing diversification and complexity of labour relations, The upward trend of mass incidents caused by labor disputes is also becoming more obvious. After the promulgation and implementation of the Labor contract Law of the people's Republic of China, the legitimate rights and interests of workers have been given fuller and more comprehensive protection. The prohibition or binding regulation of the employer makes the government face the severe situation that the labor cost is rising further and the risk of labor contract is getting worse. Therefore, Shenzhen, Yangzhou, Yueyang and other places have taken the lead in exploring and solving the problem of regulating the management of temporary personnel employed by government departments, and have obtained many experiences and results that can be used for reference. Based on the experience of international and domestic temporary employment management, this paper makes a study on how to standardize the temporary employment management in Changde City, Hunan Province. First of all, this paper introduces the research background and significance, reviews the current research situation at home and abroad, and briefly describes the research content and research methods. Secondly, this paper expatiates on some important concepts, such as temporary employment personnel, financial allocation units, compilation and so on, and sums up and analyzes the relevant basic theories. It also discusses the necessity of standardizing the management of temporary personnel employed by financial allotment units. Thirdly, according to the data and situation collected from the actual investigation, this paper synthetically summarizes the management status quo of temporary employment in Changde City, the main problems in temporary employment management, and the causes of these problems. Again, the paper summarizes the experience of regulating the temporary personnel management of financial allocation units in advanced areas of China and its possible reference to Changde City. Finally, on the basis of theoretical analysis and practical experience, some policy suggestions are put forward to standardize the management of temporary personnel employed by financial allotment units in Changde City. Through the research on this subject, the author hopes to help the theoretical researchers to make a more in-depth study on the issue of regulating the management of temporary employment in public institutions, such as government departments. It is also hoped that it can provide valuable policy advice for the Changde city government to standardize the management of temporary personnel employed by the financial appropriation units, and at the same time provide valuable experience for other regions.
