教育合同的法律适用原理

【摘要】:教育合同是我国目前教育实践中存在和司法实践部门认可的一种非典型合同。它由教育法和合同法共同调整。根据法理学关于法律规范类型划分及其功用的原理,探析各类法律规范对教育合同的调整功能,可以清楚地看到,任意性法律规范、倡导性法律规范、强制性法律规范、原则性法律规范和解释性法律规范对教育合同的调整分别具有各自的价值与作用。
[Abstract]:Education contract is a kind of atypical contract existing in educational practice and recognized by judicial practice department. It is regulated by the law of education and the law of contract. According to the principles of jurisprudence on the classification of legal norms and their functions, we can clearly see that arbitrary legal norms, advocacy legal norms, mandatory legal norms, and so on, are the adjustment functions of various kinds of legal norms to education contracts. The adjustment of educational contract by the legal norms of principle and interpretation respectively has its own value and function.
