无定期劳动合同促进雇佣双方合作双赢的思考——对《劳动合同法》的一种人力资本视角分析

【摘要】:本文试从现代人力资本理论的视角对《劳动合同法》中"无固定期限劳动合同"的条款给予新的解析,指出无固定期限劳动合同有利于保证雇佣关系的稳定性,从而为企业人力资本开发奠定良好的制度基础。因此,与学术界一些较流行的观点不同,本文认为《劳动合同法》的意义绝不仅仅在于对劳动者利益的保护,它实际上体现了一种从现代成熟的市场经济视角出发,运用法律手段规范健康有序的劳动关系,促使劳动者与企业实现合作双赢的政府的理性行为。
[Abstract]:From the perspective of modern human capital theory, this paper tries to give a new analysis of the terms of "Labor contract with no fixed term" in the Labor contract Law, and points out that the labor contract with no fixed term is conducive to the stability of the employment relationship. Thus lay a good institutional foundation for the development of human capital. Therefore, different from some popular views in academic circles, this paper holds that the meaning of Labor contract Law is not only to protect the interests of workers, but also to reflect a modern mature market economy perspective. The use of legal means to regulate healthy and orderly labor relations, to promote workers and enterprises to achieve win-win cooperation between the rational behavior of the government.
