集体合同的法律效力研究

【摘要】:随着社会的发展,集体合同制度的作用也正在逐步凸显。作为协商劳动关系的一项重要法律制度,集体合同上承劳动基准法,下启劳动合同的订立,指导和制约劳动合同的订立和履行。西方主要发达国家根据本国的实际对于集体合同的效力有着不同的规定,而我国则立法赋予工会来代表全体职工和用人单位签订集体合同。但是由于我国《劳动法》和《劳动合同法》对集体合同责任的承担均未作出明确的规定,再加上现实当中,劳资双方容易混淆一般劳动合同与集体合同之间的关系,导致目前的实践当中纠纷不断。 本文以目前集体合同实践当中存在的问题为主线,然后对于其存在的问题进行深入的分析,深入分析其存在问题的原因,然后借鉴国外的立法经验,提出解决纠纷的相关建议。
[Abstract]:With the development of society, the role of collective contract system is gradually prominent. As an important legal system for negotiation of labor relations, the collective contract carries on the labor standard law, the conclusion of the lower labor contract, the guidance and restriction of the conclusion and performance of the labor contract. The main developed countries in the West have different regulations on the effectiveness of collective contracts according to their actual conditions, while our country has legislated to give trade unions the power to sign collective contracts on behalf of all workers and employers. However, since neither the Labor Law nor the Labor contract Law of our country has made clear provisions on the responsibility of collective contracts, in addition, in reality, both employers and employees tend to confuse the relationship between general labor contracts and collective contracts. Causes the present practice in the dispute unceasingly. This article takes the existing problems in the practice of collective contract as the main line, then analyzes the existing problems deeply, analyzes the causes of the problems, and then draws lessons from the foreign legislative experience, and puts forward the relevant suggestions to resolve the disputes.
