合同陷阱及其防范——正确认识新旧合同法的差异

【摘要】：本文主要通过分析、比较1999年10月1日生效的《中华人民共和国合同法》与同时废止的《中华人民共和国经济合同法》、《中华人民共和国涉外经济合同法》、《中华人民共和国技术合同法》等旧合同法以及《民法通则》对合同订立、履行、有效、无效等的不同要求、变化 ,阐述新《合同法》的规范要求和注意事项 ,指导、帮助合同当事人正确理解、遵守新法的规范要求。
[Abstract]:Through analysis, this paper compares the contract Law of the people's Republic of China, which came into effect on October 1, 1999, with the Economic contract Law of the people's Republic of China, which was repealed at the same time, and the Foreign Economic contract Law of the people's Republic of China. "Technical contract Law of the people's Republic of China" and other old contract laws, as well as "General principles of Civil Law", have different requirements and changes for the conclusion, performance, validity and invalidity of contracts, expounding the normative requirements and matters needing attention of the new contract Law, and guiding them. Assist the parties to the contract to understand correctly and comply with the requirements of the new law.
