商品住房限购令引发的法律冲突及对策

【摘要】:自本世纪初,中国房价开始快速上涨。中央政府曾多次推出针对楼市的调控措施,房价恰恰在调控声中不断地上升。在各种政策出台没有取得实质性改善的情况下,2010年中央和地方政府终于祭出了“商品住房限购令”。 经过2010年“国十条”、2011年“国八条”两轮楼市限购新政后,包括国内一线城市、省会城市等在内的42个城市,均已实施限购。“限购令”效果显著,自实施以来,,楼市迅速降温,中央和各级地方政府均舒了口气。 但始终有人质疑“限购令”本身的合法性,本文从“限购令”最基本的概念入手,通过分析“限购令”的法律属性,得出一个重要的结论:“限购令”的法律位阶低于普通法律。再以中央、北京市政府出台的“商品住房限购令”具体条文为依据,根据法学原理,逐一比对“限购令”与《宪法》、《合同法》和《物权法》,得出它们之间的冲突。 最后总结“限购令”自身的局限性,进一步提出笔者对“限购令”调整对策。
[Abstract]:Since the beginning of this century, China's house prices have begun to rise rapidly. The central government has repeatedly introduced measures to regulate the housing market, which is rising amid the sound of regulation. In the absence of substantial improvement in policies, central and local governments finally issued the Commodity Housing purchase restriction order in 2010. After 2010 "the national ten", 2011 "the country eight" two rounds of property market limit purchase new deal, including the domestic first line city, the provincial capital city and so on, has implemented the restriction to purchase. Since its implementation, the housing market has cooled rapidly, and central and local governments at all levels have been relieved. However, some people have always questioned the legality of the order itself. This paper starts with the most basic concept of the order and analyzes the legal attributes of the order. An important conclusion is that the order is lower in legal order than in ordinary law. On the basis of the specific articles of the "Commodity Housing purchase restriction order" issued by the central government and the Beijing Municipal Government, and according to the principle of law, this paper compares the purchase restriction order with the Constitution, the contract Law and the Real right Law one by one, and finds out the conflict between them. Finally, the author summarizes the limitation of the order and puts forward some countermeasures to adjust it.
