消费者权的法律解释——基于判例与法理视角

【摘要】：从判例与法理分析视角来论证消费者权对民事主体权利的超越。消费者的安全保障权、知情权、自主选择权、批评监督权、反悔权、方便救济权超越了民法、合同法的知识结构。消费者权虽脱胎于民事权利、公民宪法权利,但消费者权立基于消费者的弱者地位,具有明显的扩张性、权利义务的非对等性等特征,体现了经济法上消费者本位的基本理念,从而使其成为经济法视野中的权利形态。
[Abstract]:From the perspective of jurisprudence and jurisprudence, this paper demonstrates the transcendence of consumer rights to civil subject rights. Consumers' right to safety and security, right to know, right to choose independently, right of criticism and supervision, right of repentance and right of convenient remedy exceed the knowledge structure of civil law and contract law. Although consumers' rights are derived from civil rights and citizens' constitutional rights, they are based on the weak position of consumers and have the characteristics of obvious expansibility and unequal rights and obligations, which embody the basic concept of consumer standard in economic law. Thus, it becomes the right form in the field of economic law.
