无固定期限劳动合同相关问题探析

【摘要】:《劳动合同法》的颁布,在制度设计上,平衡合同双方当事人的权益,但更多的人都认为本法更多的保护了劳动者的权益,对用人单位的限制性条款较多。不可否认,公权力干预劳资关系,有利于劳动者的弱势地位的提高,但大家对本法的认识还存在一定的误区,特别是无固定期限劳动合同制度,本文从该制度的立法意义出发,对现实生活中经常面临的几个问题谈谈自己的看法。
[Abstract]:The promulgation of Labor contract Law, in terms of system design, balances the rights and interests of both parties to the contract, but more people think that this law protects the rights and interests of labourers more, and there are more restrictive clauses on the unit of choose and employ persons. It is undeniable that the interference of public power in labor-capital relations is beneficial to the improvement of the weak position of labourers, but there are still some misunderstandings in our understanding of this law, especially the system of labor contracts with no fixed term. This article starts from the legislative significance of this system. Talk about several problems that are often faced in real life.
