破解中小企业工资集体协商难题的思考

【摘要】:中小企业推行工资集体协商制度难是现阶段亟待解决的问题。目前,有超过1000万家的中小企业尚未建立工资集体协商制度,占我国企业总数的80%。企业劳资双方地位悬殊,政府主导自上而下推行方式难以体现协商的意义,劳资矛盾与冲突日趋表面化和常态化,因此,应尽快制定《工资法》和《集体合同法》,改变政府GDP主导倾向,改变工资集体协商的推进方式,促进工资集体协商的法制化,落实"劳工三权",确保工资集体协商制度的实质性进展。
[Abstract]:It is difficult for small and medium-sized enterprises to carry out the wage collective negotiation system at the present stage. At present, more than 10 million small and medium-sized enterprises have not yet established a collective wage negotiation system, accounting for 80% of the total number of enterprises in China. The status of employers and employees is very different, the top-down implementation of government-led bargaining is difficult to reflect the significance of consultation, and the contradictions and conflicts between labor and capital are becoming more and more superficial and normal. therefore, the wage Law and Collective contract Law should be formulated as soon as possible, the leading tendency of government GDP should be changed, the mode of wage collective negotiation should be changed, the legalization of wage collective bargaining should be promoted, and the "three labor rights" should be implemented. Ensure the substantive progress of the wage collective bargaining system.
