目的论关照下的法律翻译—兼析《中华人民共和国劳动合同法》英译本

随着“全球化”进程的不断推进,世界各国经济、文化日益交汇融合,各国间通过制定相关法律、缔结条约,保证相互间的公平竞争,化解争端。法律翻译由此在全球范围内成为用以消解不同法系、不同语言、不同文化间的障碍的有效工具。 然而,和国际社会每日大量的法律文本的翻译实践相比,对法律翻译的研究却相对落后。国内外传统上对法律翻译的研究认为:法律翻译就是语言转换,主要从单一的词句等层面展开,单纯追求译文对原文的忠实,却忽略了法律语言的特殊性。而实际上,法律翻译的复杂性并不仅限于此,其与翻译者、翻译策略、翻译对象及功能之间的影响相辅相成。在过去的几十年里,法律翻译的研究逐步深入;随着翻译目的及对象在翻译过程中作用的明确,由德国功能翻译理论学派代表汉斯?威密尔提出的目的论引起越来越多的关注。目的论强调翻译目的在翻译过程中的决定性作用,适用于诸如法律文本翻译,此类带有特殊功能及目的的翻译行为。 本文的研究是以功能翻译理论为框架,尝试将功能目的论应用于法律文本的分析和法律翻译的实践中。由于法律翻译相应地会因为不同的交际目的而承载着不同的功用,相较于其他传统翻译理论,以目的论为代表的功能翻译理论无疑更适用于法律文...
