我国彩礼法律纠纷返还规制问题研究

【摘要】：彩礼制度是我国一种传统的婚嫁习俗,我国农村和城市普遍存在给付彩礼的现象,尤其是在广大农村地区,给付彩礼甚至成为结婚前的必经程序。近年来,由彩礼返还引发的案件纠纷日渐增多。如何认识并处理好此类纠纷,对于维护当事人的合法权益,化解当事人之间的矛盾,以及对社会的和谐稳定都具有十分重要的作用。然而,我国目前有关彩礼的法律规定过于笼统,而司法审判活动中遇到的彩礼纠纷又各种各样、千差万别,仅依靠现有规定处理彩礼纠纷类案件显然不够。因此,为解决实际问题,本文试从彩礼的含义出发,简要介绍我国现有规定,并指出司法实践中存在的问题,提出相应的完善建议,以期引起有关部门的重视,达到解决实际问题的目的。本文除引言和结语部分外,共分为四个部分：第一部分简述彩礼的含义及其性质,并指出本文作者对于彩礼性质的观点。第二部分简述我国彩礼返还规制的现有规定,并对《婚姻法司法解释(二)》中相关法律用语的理解进行介绍。第三部分简要介绍我国彩礼纠纷的典型类型并引入案例,借由案例分析指出我国司法实践中,处理彩礼类纠纷时存在的问题。第四部分是关于司法机关在处理彩礼类纠纷时,应当坚持的原则的介绍及彩礼纠纷返还规制的完善建议。该部分所介绍的相关原则是在无明确法律规定时,司法机关应当以所述原则为基础,并综合考虑本部分所提相应完善建议,在此基础上对相应问题进行处理。
[Abstract]:The bride price system is a kind of traditional marriage custom in our country. The phenomenon of paying the bride price exists generally in the countryside and city of our country. Especially in the vast rural areas, the payment of the bride price even becomes a necessary procedure before marriage. In recent years, The disputes caused by the return of the bride price are increasing day by day. How to understand and deal with such disputes well will protect the legitimate rights and interests of the parties and resolve the contradictions between the parties. However, the current legal provisions on bride price in our country are too general, and the disputes of bride price encountered in judicial activities are various and varied. It is obviously not enough to rely on the existing regulations to deal with cases of bride price disputes. Therefore, in order to solve the practical problems, this paper tries to introduce briefly the existing regulations of our country from the meaning of bride price, and points out the problems existing in judicial practice. In order to arouse the attention of relevant departments and achieve the purpose of solving practical problems, this paper is divided into four parts except the introduction and conclusion: the first part briefly describes the meaning and nature of the bride price. And points out the author's views on the nature of the bride price. The second part briefly describes the existing regulations of the regulation of the return of the bride price in China. The third part briefly introduces the typical types of bride price disputes in our country and introduces the cases, and points out the judicial practice of our country by case analysis. Some of the problems in handling disputes about bride price. 4th is about the judicial organs dealing with disputes in the category of bride price. Introduction of the principles to be adhered to and suggestions for perfecting the regulations governing the return of bride price disputes. The relevant principles introduced in this part are that, in the absence of clear legal provisions, the judicial organs should base themselves on the said principles, On the basis of comprehensive consideration of the corresponding suggestions in this part, the corresponding problems are dealt with.
