在离婚案件中运用“竞价制”分割共同财产效果好

【摘要】：正 我国婚姻法及最高人民法院之司法解释确立了离婚时夫妻共同财产分割的主要原则,即“根据共同财产的实际状况,结婚时间的长短,生产、生活的实际需要,以及财产的来源、数量等,合理分割”。但是,司法实践中,对夫妻共同财产如何分割才能体现上述原则,达到公平合理、减缓矛盾?这往往是审判实践中的一个难题。尤其是对不动产和不宜、不易分割物的处理更是这样。事实上,在离婚案件所涉及的四个主要问题即离婚本身、财产分割、子女抚养和债务负担当中,大都因财产分割问题(主要是共同财产分剖)而导致本可调解解决的案件最后却非判不可,
[Abstract]:The Marriage Law of our country and the judicial interpretation of the Supreme people's Court have established the main principles of the division of joint property between husband and wife at the time of divorce, that is, "according to the actual situation of the common property, the length of marriage time, the actual needs of production and life,"And the source, quantity, etc. of the property, reasonable division.However, in judicial practice, how to divide the common property of husband and wife can embody the above principles, achieve fairness and rationality, and alleviate the contradiction?This is often a difficult problem in trial practice.Especially for real estate and unfavorable, not easy to divide the treatment is more like this.In fact, among the four main issues involved in divorce cases, namely, divorce itself, division of property, child support and debt burden,Most of the cases that could have been settled because of the division of property (mainly the split of common property) had to be decided in the end.
