论离婚案件中按揭房产所有权人的界定及房产增值部分的分割

【摘要】:离婚案件按揭房产所有权人的界定及房产增值部分的分割问题,因现行法律并无明确规定,故理论界及司法实务界争议较大。为进一步推动该问题的深入研究,为立法者及司法实务界提供一定的理论支持,本文试就该问题展开论证。 本文可分为两大部分:第一部分从按揭房产的概念、种类及特征说起,介绍在当前的房产登记制度下,离婚案件必须界定按揭房产的所有权人,同时根据离婚时是否取得所有权、是婚前还是婚后取得所有权等,分析离婚时按揭房产所处的各个状态,之后从这些按揭房产所处的状态出发,分别界定不同状态下的法律上的实际所有权人;第二部分在第一部分界定所有权人的基础上,分析不同所有权人情况下的房产在婚姻存续期间增值部分应否分割,并主要针对不享有所有权的一方婚后支付了一定按揭款或者认定为夫妻共同财产而婚前一方支付了首付款,这两种情况下的款项性质认定以及该款项对房产增值的作用进行论证,最后参照实务界分割该部分增值款的方法,提出笔者认为较为公平合理的分割方法。 笔者在论述本文观点的同时,还逐一对最高人民法院的《婚姻法司法解释三草稿》第十三条以及上海市高级人民法院、江苏省高级人民法院、广东省高级人民、深圳市中级人民法院审判会议纪要中关于离婚案件按揭房产所有权人的界定及增值部分的分割规定进行系统分析论证。对理论界一些较有代表性的观点,本文也进行了分析。 对于离婚时按揭房产所有权人的界定,笔者的观点主要有以下四点:1、对于由婚前一方按揭并支付了所有款项,但房产所有权的取得在婚姻存续期间,并且登记在婚前一方名下的按揭房产,笔者认为所有权人为婚前一方;2、由婚前一方按揭并支付了首付款等,在婚前取得并登记了一方的名字,虽然婚后夫妻共同偿还了部分按揭款,但所有权人为登记的婚前一方;3、由婚前一方按揭并支付了首付款等,并且婚后夫妻共同偿还了部分按揭款,但所有权的取得在结婚以后,这时虽然房产证登记为一方的名字,但该房产应认定为夫妻共有;4、对于婚后取得所有权,房产是由双方婚后按揭并偿还了全部按揭款的房产,所有权人为夫妻双方。 在界定完按揭房产所有权人的基础上,笔者结合理论界、司法实务界及国外的立法观点,从一方偿还按揭款或者支付首付款对房产取得、房产增值的贡献及婚姻关系的本质等出发,分析认为对于不享有所有权的一方婚后支付了一定按揭款或者认定为夫妻共同财产而婚前一方支付了首付款两种情况下的款项,亦应随着房产的增值而增值,并在离婚时不仅要分得该款项的本金,而且增值部分亦应分割。最后,笔者针对这两种情况,提出了自认为较为合理的增值部分分割方法。
[Abstract]:The definition of divorce cases mortgage property ownership and property value-added part of the segmentation problem, because the current law does not clearly defined, so the theory and judicial practice is still controversial. In order to further promote the further study of the problem, provide theoretical support for legislation and judicial practice, this paper discusses on the issue.
This paper can be divided into two parts: the first part from the concept of real estate mortgage, speaking of the type and characteristics, introduced in the current real estate registration system, divorce cases must be defined in the mortgage real estate ownership at the same time, according to whether the ownership when the divorce is before or after marriage, ownership, analysis of each state the mortgage property at the time of divorce after that, from these mortgage real estate conditions, defined respectively under different conditions of the actual legal owner; in the second part based on the analysis of the definition of ownership, not the same ownership under the condition of property during the marriage should be part of the value of segmentation, and because the ownership of a the marriage party to pay a certain mortgage or identified as the joint property of husband and wife and the marriage party to pay the first payment, identified the two case payment properties And the effect of the amount on the real estate increment is demonstrated. Finally, referring to the way of dividing the value-added part of the practice sector, I propose a more fair and reasonable segmentation method.
The author also discusses in this view, also one by one of the Supreme People's court's judicial interpretation of the marriage law three draft > thirteenth and the Shanghai Municipal Higher People's court, Supreme People's Court of Jiangsu Province, Guangdong province higher people, definition and part of the value of mortgage real estate ownership on divorce cases in Shenzhen City Intermediate People's court in the meeting minutes the provisions of the system analysis. The segmentation of the theory with some representative viewpoints, this paper also analysis.
The definition of divorce mortgage real estate ownership, the author's point of view there are four main points: 1, the marriage party mortgage and to pay all the money, but the real estate ownership acquired during the marriage, and marriage registration in the name of one of the mortgage property, the author thinks that ownership of human marriage party; 2 and by the marriage party mortgage and paid the first payment, in premarital obtain and registered party name, although married couples together to repay part of the mortgage, but the ownership of human registered marriage party; 3, by the marriage party mortgage and paid the first payment, and to repay part of married couples the mortgage, but the acquisition of ownership in the marriage, then although the real estate registration certificate for the name of the party, but the property should be identified as community; 4, to obtain ownership of real estate is married, and the two parties after the mortgage repayment The property of all mortgages is also owned by the husband and wife.
In the end based definition of mortgage real estate owners, according to the theory, judicial practice and legislative opinion abroad, from one side to repay the mortgage, or pay the first payment of real estate, real estate value contribution and the essence of marriage, analysts believe that the ownership of a marriage party does not pay a certain the mortgage or identified as the joint property of husband and wife and the marriage party to pay the first payment under the two conditions of money, should be with the property value and value, and at the time of divorce should not only share the amount of principal, and value-added part should also be segmented. Finally, the author of the two cases, segmentation is presented methods since that value-added part more reasonable.
