婚姻法与建国初期婚姻制度改革研究

【摘要】： 1950年5月1日新中国颁布的《中华人民共和国婚姻法》是建国后颁布的一部完整系统的法律,它的立法精神和立法原则较之以前有了很大的进步。新婚姻法颁布后,在全国范围内进行贯彻执行。四川省按照中央的指示精神,在全省范围内也进行贯彻执行。在两年多的贯彻执行中,取得一定的成绩,如部分妇女开始挣脱封建婚姻制度的束缚,大胆的同不合理的封建婚姻作斗争,摆脱了封建婚姻的痛苦,争取到婚姻自由;寡妇也可以自由结婚;有不少的童养媳回到娘家等等,从而使封建婚姻制度开始瓦解。但由于几千年的封建统治和封建思想,在人们的脑海中根深蒂固,人们的封建思想意识还很浓厚,加之婚姻法的宣传工作做得不够广泛深入,不少地方尤其是农村还存在大量封建残余,干部和群众的封建思想意识还很浓厚,农村中早婚、干涉婚姻自由、打骂虐待妇女以及妇女因婚姻问题自杀被杀现象还很严重。因此,四川省根据中央贯彻婚姻法“运动月”的指示精神,在全省范围内(少数民族地区除外)进行一场宣传贯彻婚姻法的群众性运动,以彻底肃清人们头脑中的封建残余,为即将到来的大规模的社会主义建设创造有力的条件,从而推动社会主义建设快速发展。经过一个月大张旗鼓的宣传,全省基本上做到家喻户晓,经过贯彻婚姻法运动,出现了很多民主和睦、团结生产的新家庭,干涉婚姻自由、早婚和打骂虐待妇女的现象明显减少,夫妻关系、婆媳关系、父母与子女关系都得到根本改善,全省出现一片新气象。经过贯彻婚姻法运动,使广大妇女进一步从封建婚姻制度的束缚下解放出来,从而提高了妇女的家庭地位和社会地位,极大地激发了妇女的生产积极性,为即将到来的社会主义建设事业做出巨大贡献。但婚姻制度的改革是一项具有长期性和复杂性的艰巨任务,仅靠一场运动是不行的,必须经常性的宣传贯彻婚姻法,把宣传贯彻婚姻法的工作转入经常化,只有这样才能从根本上彻底消灭封建婚姻制度,才能使新婚姻制度彻底建立起来。因此,四川省根据中央指示精神,把宣传贯彻婚姻法的工作转入经常化,并制定出经常贯彻婚姻法的计划与办法,使贯彻婚姻法的经常工作有步骤有秩序地进行。本文借助大量的档案、报刊等第一手资料,从婚姻法颁布与婚姻制度改革原因、婚姻制度改革过程、婚姻制度改革带来的新气象、婚姻制度改革的评价等四个方面来研究建国初期四川省婚姻制度改革问题。本文分为以下几个部分: 前言:介绍本文的选题意义、研究方法和创新之处,概括国内外关于婚姻家庭方面的研究现状,界定了本文中四川省的空间范围。第一章:主要介绍婚姻法颁布的原因、目的、意义,并分析建国初期婚姻制度改革的原因。第二章:叙述婚姻法颁布后,四川省根据中央指示精神,在全省进行一场宣传贯彻婚姻法的工作,对封建婚姻制度分3个阶段进行改革,即婚姻制度改革初期阶段,贯彻婚姻法运动月,经常贯彻婚姻法阶段。第三章:主要研究建国初期四川省婚姻制度改革带来的新气象,即经过婚姻制度的改革,使封建婚姻制度下的夫妻关系、婆媳关系、父母与子女关系都得到显著的改善,使打骂虐待妇女、干涉婚姻自由、早婚的现象明显减少,全省出现许多民主和睦、团结生产的新家庭。第四章:分析建国初期四川省婚姻制度改革的评价,分析建国初期四川省婚姻制度改革取得的成效及其原因;并分析其不足与经验教训。结语:主要是对全文内容进行总结性的概述。
[Abstract]:The marriage laws of the People ' s Republic of China , promulgated by the People ' s Republic of China on May 1 , 1950 , are the laws of a complete system promulgated after the founding of the People ' s Republic of China . According to the central signs , Sichuan Province has transferred the publicity and implementation of the Marriage Law to the current situation , and has formulated plans and methods to carry out the Marriage Law frequently , so as to make the regular work of implementing the Marriage Law in an orderly way . In this paper , we study the reform of the marriage system in Sichuan Province in the early stages of the founding of the People ' s Republic of China on the basis of the first - hand information such as archives and newspapers , the process of the reform of the marriage system , the new weather brought by the reform of the marriage system and the evaluation of the marriage system reform .

This article is divided into the following parts :

In this paper , the author introduces the significance , research methods and innovations of this paper , summarizes the current research situation of marriage and family at home and abroad , and defines the spatial range of Sichuan Province in this paper .

Chapter One : Mainly introduces the reasons , the purpose and significance of the marriage law , and analyzes the reasons of the reform of the marriage system in the early period of the founding of the Republic of China .

Chapter 2 : After the promulgation of the Marriage Law , Sichuan Province carries out a propaganda and implementation of the marriage law in the whole province according to the central signs , and carries out the reform in three stages of the feudal marriage system , namely , the early stage of the reform of the marriage system , the implementation of the marriage law movement month , and the frequent follow - up of the marriage law stage .

The third chapter is to study the new weather brought by the reform of the marriage system in the early period of the founding of the People ' s Republic of China , that is , through the reform of the marriage system , the relations between the husband and wife , the mother - in - law , the parents and the children under the feudal marriage system are obviously improved , so that the phenomenon of abuse of women , the interference of marriage freedom and early marriage is obviously reduced , and there are many new families in the province which are democratic and harmonious and united in production .

Chapter Four : The analysis of the reform of the marriage system in Sichuan Province in the early period of the founding of the Republic of China , analyzes the achievements and causes of the reform of the marriage system in Sichuan Province in the early period of the founding of the Republic of China , and analyzes its shortcomings and lessons learned .

Conclusion : It is mainly an overview of the summary of the whole content .
