论我国重婚行为的非犯罪化

【摘要】:家庭是人生的摇篮,也是社会的细胞。现代家庭以一夫一妻制为结构主体,乃是人类进化的理性选择,也是人类社会文明的标志。重婚,是婚姻中的违法行为,与一夫一妻制的现代文明婚姻制度水火不容。世界各主要国家在立法上均有禁止重婚的规定。我国刑法规定的重婚罪对于维护一夫一妻制的婚姻家庭制度,也曾起到一定的积极作用。 然而,随着人们法律意识的觉醒,明目张胆地登记重婚的已微乎其微,重婚罪已并没有多大适用余地。反之,“包二奶”现象却日趋猖獗,不论是法律或道德的约束,还是舆论抨击,“包二奶”仍是涛声依旧,有增无减。而刑法规定的重婚罪却对此无能为力。此外,刑事司法实践中认可的事实重婚也颇有争议。这些都启示笔者对我国刑法规定的重婚罪的必要性、合理性予以重新审视。笔者窃以为,我国刑法规定的重婚罪已丧失其合理性及必要性,可以予以非犯罪化,应当重新构建防控重婚的法律体系和社会体系。 本文从婚姻制度的历史演变、婚姻的本质、事实婚姻的效力等入手,对重婚及重婚罪予以界定,并反思重婚的社会危害性。随后,笔者结合非犯罪化思想和刑法的谦抑性理论,论证重婚行为可予以非犯罪化,并针对重婚行为非犯罪化后,如何有效地防控重婚、保护受害人,提出若干建议。 本文共分九个部分: 一、序言。该部分主要介绍笔者写作的动因以及笔者主张对重婚罪非犯罪化的观点。 二、婚姻概说。该部分从婚姻制度的历史演变入手,推演出一夫一妻制是人类社会文明的标志,重婚与其水火不容。继而,笔者讨论了婚姻的概念及本质,提出婚姻是男女两性依照法律规定自愿结合而产生的夫妻关系,,明确婚姻的本质属性是其社会属性和法律属性。因而,事实婚姻并不是一种婚姻。 三、重婚与重婚罪。该部分从重婚的概念着手,首先界定民事范畴的重婚,应该排除事实婚姻。继而,笔者参考世界各主要国家关于重婚罪的规定,对重婚罪的界定及犯罪构成作了探讨,并认为重婚罪也应该排除事实婚姻,只有登记婚才可以构成重婚罪。 四、重婚社会危害性反思。该部分从犯罪的本质入手,明确犯罪是具
[Abstract]:Family is the cradle of life, but also the cells of society. Monogamy is the main structure of modern family, which is the rational choice of human evolution and the symbol of human civilization. Bigamy is an illegal act in marriage, which is incompatible with the modern civilized marriage system of monogamy. Major countries in the world have laws prohibiting bigamy. The crime of bigamy stipulated in our country's criminal law has also played a positive role in maintaining the monogamous marriage and family system. However, with the awakening of people's legal consciousness, very few people have openly registered bigamy. Bigamy does not have much room for application. On the other hand, the phenomenon of "keeping concubines" is increasingly rampant. Whether it is the restriction of law or morality, or the criticism of public opinion, the sound of "keeping concubines" is still increasing. But the crime of bigamy stipulated in the criminal law is powerless. In addition, the fact of bigamy recognized in criminal justice practice is also controversial. All these enlighten the author to re-examine the necessity and rationality of bigamy in our criminal law. The author thinks that the bigamy crime stipulated in our criminal law has lost its rationality and necessity and can be decriminalized, and the legal system and social system of bigamy prevention and control should be re-established. This paper defines bigamy and bigamy crime and reflects on the social harmfulness of bigamy. Then, combining with the decriminalization thought and the modest theory of criminal law, the author demonstrates that bigamy can be decriminalized, and how to effectively prevent and control bigamy and protect the victim after decriminalizing bigamy. This paper is divided into nine parts: first, preface. This part mainly introduces the motivation of the author's writing and the author's viewpoint of decriminalization of bigamy. Starting from the historical evolution of marriage system, this part deduces that monogamy is the symbol of human civilization, bigamy and its incompatibility. Then, the author discusses the concept and essence of marriage, and puts forward that marriage is the relationship between husband and wife that men and women combine voluntarily in accordance with the law, and it is clear that the essential attribute of marriage is its social attribute and legal attribute. Thus, de facto marriage is not a marriage. Third, bigamy and bigamy. This part starts with the concept of bigamy, first defines the civil bigamy, and should exclude the de facto marriage. Then, referring to the provisions of major countries in the world on bigamy, the author probes into the definition and constitution of bigamy, and thinks that bigamy should also be excluded from de facto marriage, and that only registered marriage can constitute bigamy. Reflection on the social harmfulness of bigamy. This part starts with the essence of crime and makes it clear that crime is a kind of crime.
