我国婚姻法建立亲权制度的理论研究

【摘要】：亲权是大陆法系各国民法亲属编中规范亲子之间保护教养关系的重要法律制度。现代的权利义务一体型的亲权，是历史演进、法律不断进步的产物。我国现阶段亲子关系日益复杂化，而我国婚姻法的相关制度存在着种种缺陷与不足，需要从我国实际出发重新构建。为此，学者提出了建立完善的亲权制度和将亲权与监护合并两种立法模式。现代国外民法中亲权制度本身的科学性，，以及亲权与监护的本质区别，决定了亲权制度是我国婚姻法完善父母对未成年子女保护教养立法的最佳选择。我国未来亲权立法应包括亲权人、亲权内容、亲权中止与停止三大制度
[Abstract]:Parental right is an important legal system in the civil law of civil law countries to regulate the protection of parental relations between parents and children. The modern rights and obligations are the product of the historical evolution and the continuous progress of the law. The parent-child relationship is becoming more and more complicated in our country at present, but the related system of marriage law of our country has all sorts of defects and deficiencies, which need to be rebuilt from the reality of our country. Therefore, scholars put forward two legislative models: establishing perfect paternity system and combining parental authority with guardianship. The scientific nature of parental right system in modern foreign civil law and the essential difference between parental right and guardianship determine that parental right system is the best choice for Chinese marriage law to perfect the legislation of parents' protection and upbringing of minor children. The future legislation of paternity in China should include three systems: paternity person, content of parental right, termination and cessation of parental right.
