财产权利与家庭政治:当代中国离婚法律实践中的房产分割

【摘要】：中国的婚姻法和离婚法律实践不同于西方既有理论的描述,其一方面遵循"个人主义"逻辑:保护个人私有财产权利,确认个人婚前财产的合法性,尊重夫妻双方的离婚及财产分割意愿,举证责任亦由当事人承担;另一方面,也遵循"家庭主义"逻辑:法律判决考虑保护弱者、照顾子女、赡养老人,调解仍然被广泛使用,是否在婚姻存续期内购买房屋仍是判定夫妻共同财产的因素之一,并且,离婚诉讼当事人在家庭正义观念方面具有一致性。从离婚法律实践来看,中国的家庭伦理在变化中仍然延续。
[Abstract]:The legal practice of marriage and divorce in China is different from the description of the existing theories in the West. On the one hand, it follows the logic of "individualism": to protect the right of private property of individuals and to confirm the legitimacy of personal property before marriage. The burden of proof is also borne by the parties concerned. On the other hand, the burden of proof is also borne by the parties concerned. On the other hand, it follows the logic of "family doctrine": the legal judgment considers the protection of the weak, the care of children, the maintenance of the elderly, and mediation is still widely used. Whether to buy a house during the marriage period is still one of the factors determining the couple's common property, and the divorce litigant has the consistency in the concept of family justice. From the practice of divorce law, family ethics in China is still changing.
