夫妻财产关系中善意第三人保护研究

【摘要】： 本文以夫妻财产关系中善意第三人保护为研究基点和线索,针对夫妻财产关系的特殊性,将第三人利益保护制度引入夫妻财产关系之中,进而提出我国婚姻法中保护夫妻财产关系中善意第三人利益的基本模式和规则。善意第三人保护问题是研究交易安全维护的一个非常重要的问题。并且第三人保护制度研究已经非常成熟。婚姻法作为民法的特别法,夫妻财产关系是其中特别的民事关系具有其特殊性。除从属于身份关系外,也同其他民事财产关系一样具有相对性,即可发生于夫妻之间。在开放的社会,婚姻关系置于社会关系之中,财产权利义务关系还会发生于夫妻以外,即夫妻作为交易主体时,涉及第三人的利益。因此,在设计夫妻财产关系的各项制度中,必须充分考虑对善意第三人保护,这样才能维护社会交易秩序的安全,提高市场机制运行的效率。本文从实体法和程序法两方面来论述夫妻财产关系的各项制度中善意第三人保护问题。将善意第三人保护的民法原理和夫妻财产关系的特殊性相结合,来设计夫妻财产关系中各项制度以保护善意第三人。本文主体部分分为四章。第一章介绍本文的选题意义、国内针对夫妻财产关系中善意第三人问题的研究现状、论文的结构安排。第二章从善意第三人保护的法理基础出发对夫妻财产关系中的善意第三人进行界定,从而为下文的论述提供了研究基点和线索。第三章和第四章分别从实体法和程序法两个角度对夫妻财产关系中的各项制度应如何设计来充分保护善意第三人进行分析讨论。最后为结论,在前面几章探讨的基础上为夫妻财产关系中的第三人保护机制提出了构建模式。
[Abstract]:This paper takes the protection of bona fide third party in the property relationship of husband and wife as the research basis and clue, aiming at the particularity of the property relationship of husband and wife, introduces the system of protecting the interests of the third party into the property relationship of husband and wife. Then it puts forward the basic mode and rules of protecting the interests of bona fide third party in the matrimonial law of our country. The protection of bona fide third parties is a very important issue in the study of transaction security maintenance. And the third party protection system research has been very mature. As a special law of civil law, marital property relationship is a special civil relationship with its particularity. In addition to subordinate identity, it is also as relative as other civil property relations, which can occur between husband and wife. In an open society, marital relations are placed in social relations, property rights and obligations will also occur outside the husband and wife, that is, when husband and wife are the subject of transactions, the interests of the third party are involved. Therefore, in order to maintain the security of social transaction order and improve the efficiency of market mechanism, we must fully consider the protection of bona fide third party in the design of marital property relations. This paper discusses the protection of bona fide third party in various systems of matrimonial property relations from two aspects of substantive law and procedural law. This paper combines the civil law principle of the protection of bona fide third party with the particularity of the property relationship between husband and wife to design various systems in the property relationship of husband and wife in order to protect the third party in good faith. The main part of this paper is divided into four chapters. The first chapter introduces the significance of this paper, the domestic research on the third person in good faith, the structure of the paper. The second chapter defines the bona fide third party in the property relationship of husband and wife from the legal basis of the protection of bona fide third party, thus providing the research basis and clue for the following discussion. The third chapter and the fourth chapter analyze and discuss how to fully protect the bona fide third party in the property relationship between husband and wife from the perspective of substantive law and procedural law. Finally, on the basis of the previous chapters, the author puts forward the construction model of the third party protection mechanism in the property relationship between husband and wife.
